Selling a junk car in Benicia

For many Benicia sellers the snag is a title that vanished years ago, not the car. Because California titles are a state matter, Benicia owners fix that through DMV with a single form. We looked in the online code libraries and could not find a Benicia junk-vehicle ordinance. That is why local rules only get a brief mention here, though Benicia may still have some. We buy whole non-running and junk cars, and pickup is free anywhere in the US.

No title in the drawer

Benicia owners use REG 227, the "Application for Replacement or Transfer of Title." File it ahead of the sale. As the name says, it does two jobs, replacing the lost title and carrying the transfer. Submit it at DMV or by post. The fee is $28, set by Vehicle Code 9265. Expect the new Benicia title in the mail roughly 15 to 30 days afterward.

If the DMV file still shows a legal owner or lienholder, section 5 of REG 227 has to be notarized. Signing the actual title does not: California DMV's seller steps list no notary for it.

Sometimes ordinary proof of ownership simply cannot be found. DMV's junking manual then draws a line at value. At $5,000 or above, a motor vehicle bond is required. Under $5,000 in value, a Benicia car needs no bond. Mail a REG 256 Statement of Facts along with your proof of ownership. On that form you name who sold you the Benicia car, give its value, and state that it has no lien. These are DMV thresholds, not prices. More in selling with no title.

What a brand on a Benicia title means

California keeps a short list of title brands, and "Salvaged" is the one most branded Benicia cars carry. The others are "Warranty Return (Lemon Law Buyback)," "Original/Prior Police," "Original/Prior Taxi," "Non-USA (Grey Market)," "Park Trailer" and "Remanufactured." It covers crash, flood and vandalism damage, as well as cars dismantled at some point. California keeps no flood brand of its own.

Salvage status has no damage percentage trigger either. Under Vehicle Code 544, a Benicia car turns into total loss salvage when its owner or insurer judges the repair not worth the money. From then on, the Benicia car has a salvage certificate where its title used to be. A Benicia car that Vehicle Code 431 calls nonrepairable can never be titled or registered again. See salvage title.

Local rules in Benicia

Vehicle Code 22660 lets Benicia adopt an ordinance to clear cars that are abandoned, wrecked, dismantled or inoperative off public or private land and bill for the work. Ask Benicia which rule covers your block. Benicia falls under Vehicle Code 22523 too. Leaving a car on a highway is banned there, and so is leaving it on another person's land unless they agreed. A Benicia owner caught doing this owes $100 or more and must show the tow bill was paid.

Handing the car over

Sign the title, with any lienholder also signing, and your buyer takes it to DMV. Standard plates generally stay put. Next, the Benicia seller files REG 138, the "Notice of Transfer and Release of Liability," within five days. Mail it in or use dmv.ca.gov/nrl. Tickets after that belong to the buyer. State rules in full are on the California page.

Questions people ask

The title to my old Benicia car is gone. Which form replaces it?
REG 227, filed at DMV or mailed in. A replacement costs Benicia owners $28. Most get the new title in 15 to 30 days. That form can also carry the transfer.
Will a Benicia sale need a notary?
For signing the title itself, California DMV's seller steps list no notary. Benicia sellers see a notary only for REG 227 section 5. That page needs one when DMV records list a lienholder or legal owner.
Could my Benicia car's title carry a flood brand?
Not a separate one. California brands such damage Salvaged, whether from a crash, high water or vandalism, and uses the same word for previously dismantled cars.
