Beverly Hills junk cars and the enclosed-space rule

Beverly Hills gives a dead car no countdown on a residential lot. Section 5-6-901 says "No motor vehicle shall be stored or parked on private property in any district zoned for residential purposes except in an entirely enclosed space, unless such vehicle is capable of movement under its own power." There is no ten-day window in that sentence. If the car cannot drive into the garage, we buy whole non-running and junk cars. You sell the whole car as it sits, and pickup is free anywhere in the US.

A car on PNO still counts

Section 9-1-1602 rewrites the property maintenance code's definition of an inoperable motor vehicle. In Beverly Hills it is one "which cannot be driven upon the public streets for reasons including but not limited to being registered nonoperational, unlicensed, wrecked, abandoned, in a state of disrepair, missing components, incapable of being moved under its own power."

That first item catches people. Filing a Planned Non-Operation (REG 102) stops California's back fees from piling up on a parked car. It does not make the car acceptable to the city outside an enclosed space.

Yards and street parking

Section 5-7-4 separately lists "Abandoned, wrecked, dismantled, or inoperative automobiles, trailers, campers, boats, and other motor vehicles which are accumulated or stored in yard areas" as a prohibited condition. Junk or salvage that can be seen from a street, alley or next-door property is on the list too.

On the street, Section 7-3-110 lets a car that stays illegally parked collect a second citation once at least two hours pass after the first. No more than two citations may be issued for continuous illegal parking in 24 hours. If the car is impounded, Section 2-3-203 has the police chief run impound hearings under Vehicle Code 22851.3 and related state rules.

Title and plates from Beverly Hills

The title side is a California DMV matter. You sign as the owner of record, and so does any lienholder. The person buying your Beverly Hills car brings the title to DMV with the $15 transfer fee. DMV's steps for sellers never call for a notary. If the title cannot be found, REG 227 brings a replacement for $28.

A Beverly Hills seller has 5 days from the sale to file REG 138. After that, new tickets go to the buyer. Standard plates usually go with the car. For a fee, you can keep a personalized plate for yourself. Because the car is headed to a dismantler, it needs no Smog Check.

Questions people ask

Is a car that won't start allowed to stay in my driveway in Beverly Hills?
Not in a residential district. Section 5-6-901 says no motor vehicle may be stored or parked on private residential property except in an entirely enclosed space unless it can move under its own power. A garage works; a driveway or carport does not.
I filed a Planned Non-Operation for the car. Does that help with the city?
It helps with DMV fees, not with the city. Section 9-1-1602 counts a car registered as nonoperational as an inoperable motor vehicle in Beverly Hills. So a car on PNO still has to be kept in an enclosed space.
How are impound hearings handled in Beverly Hills?
Section 2-3-203 has the police chief run administrative hearings for impounded vehicles under Vehicle Code section 22851.3 and related state law.
