Selling a junk car in Brawley

Brawley gives a wrecked or dead car three days. Section 17.99.6 of the city code makes it an infraction to "abandon, store, leave, or permit the abandonment, storing, or leaving" of any vehicle "which is abandoned, wrecked, dismantled or inoperative upon any private or public property, including highways, within the city for a period in excess of seventy-two or more consecutive hours." The section has a few exceptions. If your car is stored inside, read them on the city's code page.

The steps Brawley follows

Once the city's vehicle abatement officer finds one of these cars on private or public land in Brawley, Section 17.99.7 lets the officer start removal. The code sets the schedule from there:

  1. The notice. Under Brawley's Section 17.99.10, the city must give "a ten-day notice of intention to abate and remove the vehicle." It goes out registered or certified to the car's legal owner and last registered owner, plus the landowner named on the last equalized assessment roll. It warns the landowner to remove the car "within 10 days from the date of mailing of this notice." If the landowner doesn't, the city removes it, and "the costs thereof, together with administrative costs, will be assessed to you."
  2. The hearing. Under 17.99.11, the vehicle owner or the landowner has ten days from the mailing to request a public hearing. The planning director, or a subordinate the director designates, acts as hearing officer. A landowner can mail in a sworn statement saying the car is not theirs to deal with. That counts as the request, and they do not need to show up.
  3. The disposal. Under Section 17.99.14, the car can be sent to a scrap yard or automobile dismantler's yard five days after the later of two dates: when the nuisance order is adopted or when the decision is mailed.

If the landowner and the vehicle's owner both sign releases, no notice is needed. A car hauled off under this article is finished. Under Brawley's code, the car "shall not thereafter be reconstructed or made operable." Brawley allows one way out: a car that can qualify for historical vehicle or horseless carriage license plates.

Street parking and big trucks

Section 17.91-14 ties street impounds to Vehicle Code 22651(w). Vehicle Code 22651 lets Brawley tow a car parked in one place for 72 hours or longer when a local ordinance bans that.

A dead work truck has a rule of its own. Section 17.95-2 bans parking commercial trucks over twenty-four feet long or three tons gross weight, at any time, on streets beside the city's residential and mixed-use areas. The same section lets a truck tractor park there on a permit.

Civil Code 3068.1 gives a Brawley tow yard a possessory lien on any car it holds. Civil Code 3072 governs the sale of a Brawley car worth $4,000 or less. Brawley tow yards post a "Notice of Pending Lien Sale" first, then sell the car 31 to 41 days later. In Brawley, an owner who wants a judge to hear it returns the "Declaration of Opposition" within 10 days. More in towed or impounded.

California paperwork from Imperial County

Imperial County has no title counter. California handles titles at state-run DMV field offices.

  • The California Certificate of Title gets signed by the Brawley seller, plus any lienholder that is listed. The buyer pays the $15 transfer fee at DMV. You won't find a notary among the DMV's steps for sellers.
  • REG 138 is due from a Brawley seller no later than 5 days after the sale. The DMV takes it through dmv.ca.gov/nrl or in the mail.
  • Ordinary plates usually stay with the car. A personalized plate can be reassigned to another vehicle for a fee.
  • No Smog Check applies when a Brawley car goes to be wrecked or dismantled.
  • If the title is gone, REG 227 comes first, and a replacement costs $28. See junk car with no title.

Questions people ask

Is there a waiting period before a Brawley wreck becomes an infraction?
A short one. Under 17.99.6, leaving a vehicle that is "abandoned, wrecked, dismantled or inoperative" on private or public property beyond "seventy-two or more consecutive hours" is an infraction. The section has exceptions, so check its text if the car is kept inside.
What happens after Brawley mails a notice to abate?
The landowner has ten days from the mailing date to clear the car. In that window, either the landowner or the vehicle's owner may request a public hearing. If no one does, the vehicle abatement officer can order removal, and the costs fall on the landowner.
Can a car the city hauls away be fixed later?
No, with one exception. Once Brawley tows a car under Section 17.99.14, it "shall not thereafter be reconstructed or made operable" unless historical vehicle or horseless carriage plates are open to it.
Does a Brawley seller have to get the title notarized?
No. The DMV's private-sale steps skip it. In Brawley the seller signs, a lienholder signs if there is one, and the buyer turns in the title with the $15 transfer fee. No notary step appears.
