Selling a non-running car in Cypress
For a dead car in Cypress, the expensive mistake is usually the tow, not the breakdown. Under Civil Code 3068.1, a Cypress tow or storage yard holds a lien on every car in its care. If the car is valued at $4,000 or less, a Cypress lien sale may be only weeks away. That figure is the law's cutoff, not a price. Sell before it gets that far: we buy whole non-running and junk cars, and you sell the whole car as it sits.

How a towed car gets sold out from under you
Civil Code 3072 sets the steps for cars worth $4,000 or less:
- The lien sale on a Cypress car has to begin no later than 15 days after the yard's lien takes effect.
- The lienholder mails a Notice of Pending Lien Sale.
- That mailing starts a 31-to-41-day countdown to the sale date.
- To ask for a hearing in court, return a Declaration of Opposition inside 10 days.
Storage can be charged under the lien for up to 60 days, and 120 in some cases. Cars worth more than $4,000 fall under CC 3071 instead. Our towed or impounded page goes into redeeming a car.
Why the release form matters here
Leave the impounded car unclaimed and VC 22523 holds its last registered owner responsible for an infraction plus any amount the sale leaves unpaid. The REG 138, which is the report of sale under VC 5602, lifts that burden, even when a buyer is the one who later dumps the car.
What starts a tow in the first place
We couldn't get the Cypress municipal code online. Vehicle Code 22660 lets any California city pass an ordinance for clearing dead and wrecked cars off lots and streets at the owner's cost, so a Cypress driveway may come with local limits. A call to the city settles it.
Curbside, VC 22651 already permits towing a car that has stayed put three days straight where a local ordinance forbids it.
The registration ran out while it sat
Every year the car went unregistered can come with DMV fees and penalties, the exception being a car filed as Planned Non-Operation on REG 102. That is worth knowing before you plan to drive a long-parked car anywhere, Orange County streets included.
Title and plates
A Cypress seller signs the Certificate of Title, as does any lienholder. The buyer pays the transfer fee when filing it at DMV. The DMV's seller instructions skip any notary. REG 138 is due inside 5 days, through the DMV site or on paper. Recorded, it puts post-sale parking tickets, traffic violations and civil claims on the buyer instead of you.
Regular-issue plates usually go with the car. If yours are personalized or a special design, you may keep them for another car by paying a fee. After you sell lists the rest.

Getting an offer
Use the form or (877) 421-6008: which car it is and how old, how many miles, running or not, and whether the title is clear. Pickup is free anywhere in the US, so the truck can come to a Cypress driveway, a parking lot, or the tow yard once it lets the car go.
Questions people ask
- I got a "Notice of Pending Lien Sale" in the mail from a tow yard in Cypress. Now what?
- It means a lien sale is coming. Civil Code 3072 lets a Cypress tow or storage yard sell a car 31 to 41 days after it sends notice. A Cypress owner who wants a judge to look at the lien sale has 10 days to mail in the Declaration of Opposition.
- Can I sell a car that a tow yard is holding?
- In Cypress, Civil Code 3068.1 lets the yard keep a lien by holding the car, so it sits there until the lien is settled. Once it is released, the car can be sold like any other.
- Does Cypress have its own rule for dead cars on private property?
- Its code was not online where we looked. Because California lets each city pass an abatement ordinance, Cypress could have one; the city can tell you.
