Selling a dead or junk car in Oakley
In Oakley, a car that looks dead gets three days in the front or side yard. Section 4.29.408 of the municipal code prohibits "the parking of any disabled vehicle, boat, camper or trailer, or any that appear inoperable, within the front yard or side yard setback" for more than seventy-two hours. When that clock is running, we buy whole non-running and junk cars. You sell the whole car as it sits, and pickup is free anywhere in the US, right from the driveway.

Appearance counts
The rule does not ask whether the car can actually run. A car "that appear[s] inoperable" falls under it too, even if it would start.
No parting it out out front
The same section bans a set of activities in the front yard setback. The first on the list is "wrecking, dismantling, disassembling, manufacturing, fabricating, building, remodeling, assembling, repairing, painting or servicing" any motor vehicle there. Pulling an engine or stripping a car for parts in the front of an Oakley lot is off the table. That is one reason some owners sell the car whole instead; part it out or sell it whole weighs the two.
Gravel and dirt
Parking any vehicle on an unimproved surface is also prohibited "unless it is located outside of the required front yard setback and screened by a minimum six-foot-tall solid fence." A dead car on the dirt strip beside the garage needs that fence or a paved spot.
On the street
The code sections we checked set no Oakley street-parking limit. Statewide, Vehicle Code 22651 still permits a tow when a car stays put on a public road for three straight days in breach of a local rule.
Title, smog and plates
In Oakley the owner signs the California Certificate of Title, plus any lienholder still on it. The DMV's seller steps for an Oakley sale don't call for a notary. The state DMV handles titles; no county office is involved. In Oakley, the buyer pays the DMV the $15 transfer fee. A title that has gone missing means filing REG 227 first, at a replacement fee of $28.
Oakley sellers must get REG 138 to the DMV within five days of the sale. In Oakley you can mail it in or submit it through dmv.ca.gov/nrl. Oakley sellers whose car is going to be dismantled can skip the Smog Check entirely. Unless they are personalized or special, the plates normally stay with the car; those two kinds can be reassigned for a fee.

Questions people ask
- In Oakley, how long may a dead car sit in a front yard?
- Seventy-two hours. Section 4.29.408 bars a disabled vehicle, or one that looks inoperable, from the front or side yard setback beyond that. The same goes for boats, campers and trailers.
- Can I take parts off the car in the driveway?
- Not in the front yard setback. Section 4.29.408 lists wrecking, dismantling, disassembling, repairing, painting and servicing a vehicle there as prohibited activities.
- Is the dirt strip beside the house an option?
- Only when it's kept out of the required front setback and screened by a solid fence six feet tall or more. Otherwise Section 4.29.408 prohibits parking on an unimproved surface.
- Will I need a smog certificate to sell an Oakley junk car?
- No. DMV's junking manual excuses transfers of cars that will be dismantled from the smog requirement.
