Junk and dead cars in San Juan Capistrano

Dana Point, 2.8 miles from San Juan Capistrano, mails a 10-day notice before hauling a junk car off private land. We searched for San Juan Capistrano's own junk-vehicle ordinance and came up empty, so state statutes carry this page; City Hall may still enforce something stricter. Whatever applies, we buy whole non-running and junk cars: sell the whole car as it sits, with free pickup anywhere in the US.

The next town over, for comparison

Dana Point next door sends "a 10 calendar-day notice of intention to abate and remove" to the landowner, and also to the registered owner of the car if that's a different person. That is Dana Point's rule, not San Juan Capistrano's. It is one Orange County city's use of Vehicle Code 22660, the statute letting councils declare junked or abandoned cars a nuisance and recoup removal costs. For a car sitting on a lot in San Juan Capistrano, ask the city which rule it follows before any notice arrives.

How state law handles a cheap abandoned car

State law runs a separate track when an abandoned car's value is $500 or under (VC 22851.3). Treat those dollar lines as legal tests, not as anyone's appraisal of your car:

  1. Three days' warning (72 hours) gets posted on the car before towing; that step is skipped if the car rates $300 or under and goes under VC 22669(d).
  2. Within 48 hours after towing, the owner is notified.
  3. Fifteen days after that notice, disposal is allowed.
  4. The window to demand a hearing closes after 10 days.

Separately, VC 22523 pins an infraction, plus whatever the lien sale leaves unpaid, on the last registered owner of an impounded car nobody reclaims. Filing a report of sale beforehand is the escape.

Smog, and the car that cannot pass

Where the car is going decides the smog question. Headed to a wrecker or dismantler? Then no Smog Check. Headed back onto the road? The seller owes the buyer a passing test, unless the car is a motorcycle, an EV, a diesel of model year 1997 or older, a gas car of 1975 or older, or a gas or hybrid car within four model years of new.

Tighter still: a San Juan Capistrano car below Air Resources Board standards can go only to dealers or to someone legally wrecking or dismantling it under VC 24007, with a compliance or noncompliance certificate from the seller at delivery. Failed inspection covers the options.

Title, plates and the release form

Orange County has no role in titles; California's DMV runs them. Signatures go on the state title from you and from any lender still listed, and after that your buyer handles the filing. A notary is absent from DMV's seller instructions. No title in hand? REG 227 has to be done before anything else; see selling with no title.

Standard plates in San Juan Capistrano usually stay on the car for the buyer, but if DMV records it as Junk, they go to the state. San Juan Capistrano sellers owe DMV the REG 138 release within five days of the sale.

Questions people ask

Does San Juan Capistrano have its own abandoned-vehicle ordinance?
We could not find it online. San Juan Capistrano could pass its own, since Vehicle Code 22660 lets any city do so.
My San Juan Capistrano car doesn't meet Air Resources Board rules. Can I still sell it?
In San Juan Capistrano, VC 24007 allows only two kinds of buyers. One is a dealer, the other a person who will lawfully wreck or dismantle the car. The San Juan Capistrano seller hands the buyer a certificate of compliance or noncompliance when the car is delivered.
If someone abandons the car after I sell it, am I still liable?
No, provided you filed a report of sale. VC 22523 treats that filing as clearing the former owner of both the infraction and any lien-sale shortfall.
