Selling a dead or junk car in Casselberry

Keep a broken car on a Casselberry lot long enough and the code can start calling the property a junkyard. Section 5-21.2 says "the storage of nonoperable machinery, equipment or automobiles for 60 days or longer shall be prima facie evidence the property is a junkyard." Another rule can reach a dead car well before that. We buy whole non-running and junk cars, taken as they stand, flat tires and all, with free pickup anywhere in the US.

Section 82-13 and the ten-day notice

No one in charge of a property in the city, whether "owner, tenant, occupant, lessee, or otherwise," may let "any unlicensed and/or inoperable vehicle" stay there. The exceptions are a "completely enclosed building" and the lot of an auto repair or storage business holding a city license. The code lists the evidence it looks for:

  • wrecked, or inoperative "as evidenced by vegetation underneath as high as the vehicle body or frame"
  • refuse or debris collected underneath, or the car used only for storage
  • taken partly apart, with the engine, transmission or other major visible sections gone
  • "no valid license tag"

The Code Enforcement Officer posts written notice on the car itself, stating it "must be removed within ten calendar days." You may appeal in writing to the Code Enforcement Board. Without an appeal, a car still in violation after the ten days is removed to a storage facility the city approves and then disposed of under state law or city ordinance.

Section 3-10.9 names the two ways out: the car must be "currently licensed and be rendered operable," or it must be "parked in a garage or removed from the property." Inside a planned unit development, Section 3-10.2 bars keeping an inoperative car anywhere but a completely enclosed building.

Streets: 48 hours

A dismantled, wrecked, junked or nonoperating vehicle "shall be deemed to have been abandoned if it remains parked on a City right-of-way for more than 48 consecutive hours" (82-13). Under 82-75, police can have a car impounded through the city's tow franchise agreement when it is left on public property against state or city rules, and release it to its owner once any fine and the towing and storage charges are paid. On private property, removal is the property owner's responsibility.

Title office: Sanford

Seminole County's FLHSMV-listed office is in Sanford at 1101 E. First St., (407) 665-1000. From the center of Casselberry it is about 11 miles, heading north as the crow flies.

Florida's seller steps

  1. Complete the seller's part printed on the face of the title. No notary is required in Florida.
  2. Keep the tag. It can be moved to a new or replacement car.
  3. Within 30 days of the sale, file the Notice of Sale on HSMV 82050. The law makes this mandatory, and it is what detaches your registration from the car.
  4. Still making payments? Casselberry sellers with a loan must clear it first, and the lender has to report the payoff, before ownership moves. See still owe on the loan.

Then the Casselberry buyer has 30 calendar days to seek a new title, or a late fee kicks in. After you sell covers insurance and the rest.

Questions people ask

How long do I have after Casselberry posts a notice on my car?
Section 82-13 has the Code Enforcement Officer leave written notice on the car, giving ten calendar days to remove it. You can appeal in writing to the Code Enforcement Board. With no appeal, a car still in violation after that period is removed to a city-approved storage facility.
Does a car with no engine count as junk in Casselberry?
Yes. Section 82-13 lists having no engine, transmission or other major visible part as evidence, along with weeds grown up underneath to the height of the body or frame, and having no valid license tag.
When does a car parked on a Casselberry street count as abandoned?
A dismantled, wrecked, junked or nonoperating vehicle is deemed abandoned if it stays parked on a city right-of-way for more than 48 consecutive hours.
