Selling a dead or junk car in Cooper City

A posted notice on a car in Cooper City carries a right many owners never hear about. Section 25-11 says "a hearing before the City Manager shall be afforded anyone claiming an interest in the noticed vehicle, within ten days (30 days if a boat) of the posting of such notice." There you can show why the car is not abandoned. If it really is finished, we buy whole non-running and junk cars. You sell the whole car as it sits, and pickup is free anywhere in the US.

What 25-11 forbids

No one may "deposit, store, keep or permit to be deposited, stored or kept in the open upon public or private property an abandoned vehicle." What counts as abandoned comes from the city's definitions in Section 21-8. For this rule, "public property" means ground owned by any government inside the city: streets, sidewalks, parkways, parks, playgrounds and rights-of-way among them.

After the hearing window, the city can remove, destroy or sell the car, and waiting does not make the cost disappear. An owner who leaves it there "between the date of posting of notice and seizure by the City shall be liable to the City for all costs of removal and destruction, less any salvage value received."

There is a quicker track, too. When an enforcement officer finds an abandoned vehicle is "an immediate or imminent threat or hazard to traffic, persons or surrounding property," it can be moved first to a spot the city picks and posted there.

Swales, closed parks and city tows

Section 17-19 forbids parking on a swale or unpaved right-of-way that borders another person's property without consent from whoever maintains it, "including homeowners associations." Trailers, boats, commercial vehicles and RVs that are barred from residential lots may not park on streets or swales either. Section 17-18 shuts city lots, fields and parks to parking once the building or park is closed.

When the city tows under Section 17-20, say a disabled car blocking traffic or one left where it obstructs the road, "the charge for towing or removal of any vehicle under this section and storage charges shall be subject to review and approval by the City Manager or his/her designee."

Title steps from Cooper City

The Broward FLHSMV site we point Cooper City sellers to sits at 1800 NW 66th Ave. in Plantation, inside Suite 101. Dial (954) 765-4697 with questions. Distance as the crow flies: roughly 8 miles, northeast of Cooper City.

Florida's seller section on a paper title asks for the buyer's name and address, odometer, price and sale date, and no notary signs it. In order:

  1. Pull your plate. It stays with you, not the car.
  2. Sign over the title.
  3. Send FLHSMV form HSMV 82050 inside 30 days. The notice of sale asks the seller for parts 1 and 3 only, and leaves the buyer's signature optional.

Florida brands water-totaled cars: after a flood total-loss declaration, the state stamps the title, and only then can the car be sold. See flood damage.

Questions people ask

Can I challenge an abandoned-vehicle notice in Cooper City?
Yes. Section 25-11 gives anyone claiming an interest in the noticed vehicle a hearing before the City Manager or a designee within ten days of the posting, or 30 days for a boat. At the hearing you may present evidence that the vehicle is not abandoned.
If the city hauls the car away, do I still owe money?
Yes. An owner who fails to remove the vehicle between the posting and the city's seizure is liable for all costs of removal and destruction, less any salvage value the city receives.
Can I leave a car on the swale in front of my neighbor's house?
Not without consent. Section 17-19 bars parking on a swale or unpaved right-of-way that abuts someone else's property unless the person who maintains it, including a homeowners association, agrees.
