Selling a dead or junk car in Parkland

Parkland gives a dead car three days. Once a city enforcement officer posts a notice, Section 7-5 says the vehicle "must be removed within three (3) days from the date of the notice", or the case goes to the special master or the county court. A wreck is not required. Tires left flat past 72 hours are enough. If you want the car gone instead, we buy whole non-running and junk cars. You sell the whole car as it sits, and pickup is free anywhere in the US.

What makes a car "abandoned" in Parkland

The word is broader here than most people expect. Section 7-5 calls any "wrecked, inoperative, or partially dismantled" car, trailer or boat an abandoned vehicle, and it adds a second test that has nothing to do with condition: a vehicle "for which there is no valid license tag affixed to the vehicle or current registration shall constitute an abandoned vehicle". A car that runs fine on a lapsed tag fits.

Inoperative has its own definition. It covers a car parked "without having all the wheels mounted", one "in a condition of substantial disrepair", or one "parked or stored without having tires inflated", when that goes on "for a period in excess of seventy-two (72) hours".

It is "unlawful for any person to store abandoned vehicles outside of an enclosed building." The exception is a licensed, properly zoned business that accepts such vehicles.

The slower nuisance track

Section 4-21 runs a separate Nuisance Abatement Program. It declares a nuisance the "unsheltered storage for a period of thirty (30) days or more" of "old and unused stripped junk and other automobiles not in good and safe operating condition". It also lists "abandoned or inoperable motor vehicles" among the things that can be an attractive nuisance to children.

If an owner ignores the notice, the city may clear the nuisance itself and be reimbursed for the cost. A repeat of the same violation on the same property within 12 months can be cleared without a new notice, when the first order says so.

After a storm

Section 2-101, the city's civil emergency rules, defines an abandoned vehicle as one in a "wrecked, inoperative, junked, or partially dismantled condition" and lets the city manager "authorize the removal of abandoned vehicles pursuant to current state statutes" after a disaster. A car ruined in a storm is still yours to sell before that happens.

Title work for a Parkland seller

One Broward office we looked up is at 1800 NW 66th Ave., Suite 101, Plantation, phone (954) 765-4697. In a straight line it's about 12 miles south of central Parkland. Broward may have other offices too.

Three Florida rules matter most for a car like this:

  • Clear the loan first. A Parkland title stays put until the lender is paid and marks the lien satisfied. See still owe on the loan.
  • No notary. A Parkland seller signs the seller's section on the title front and writes in the buyer's name and home address, miles, price and date there too.
  • Old car, no title. A Parkland car worth under $1,000 and 10 or more model years old can use Florida's derelict certificate, HSMV 82137. You count its model year as year one. It goes to a licensed salvage dealer or registered recycler and is never titled again.

After the sale, file the Notice of Sale within 30 days, and keep the plate, which in Florida belongs to the seller.

Questions people ask

How long can a car with flat tires sit in Parkland?
Under Section 7-5, a car parked without all its wheels mounted, without its tires inflated, or in substantial disrepair counts as inoperative once that lasts more than 72 hours. An inoperative car is an abandoned vehicle under the section, and storing one outside an enclosed building is unlawful.
What happens after Parkland posts a notice on my car?
The notice gives three days to remove the vehicle. If it's still there, or still fits the definition, the case goes to the county court or the code enforcement special master.
Is a car with an expired tag abandoned in Parkland?
Section 7-5 says a vehicle with no valid tag affixed or no current registration constitutes an abandoned vehicle for that section, even if it runs.
Can I sell a car I still owe money on?
Not until the lien is satisfied. FLHSMV says the lienholder must report it paid before the title can be transferred.
