Selling a dead or junk car in Crystal Lake

Crystal Lake is in McHenry County, which puts its gas cars from 1996 on into the Illinois emissions program from age four. We buy whole non-running and junk cars, and you can sell the whole car as it sits.

The city code, and the state law behind it

We searched online and couldn't find a Crystal Lake ordinance on junk or inoperable cars. Below is Illinois law, which is the minimum. The city could add stricter or different rules.

State law hands each city the choice. 65 ILCS 5/11-40-3 lets a municipality pass an ordinance that calls inoperable cars in public view a nuisance, fines owners who don't act, and lets police tow one a week after the city gives notice. Nothing kicks in by default; the city council has to act.

The statute reaches a Crystal Lake car that has sat seven days or more lacking an engine, wheels or other parts, or that damage keeps from moving by itself. Cars laid up only for routine maintenance are left out.

A car left on someone else's land

When a car sits on private land that its owner does not own, in public view, Illinois lets police tow it after a wait of at least seven days. What happens next depends on age:

  • Up to seven model years old: the owner and lienholder have 30 days from notice to claim it. Otherwise the Crystal Lake car is auctioned, and only the towing company or a licensed recycler, rebuilder or scrap processor may bid.
  • Older than seven years: police keep it 10 days or more while they track down the owner, then can clear it for junk or salvage.

Our car abandoned on your property guide walks through the other side of this.

Emissions in McHenry County

Gas passenger cars from model year 1996 on fall under the Illinois EPA program once they turn four. Even-year models test in even years, odd in odd, during the month the registration runs out. A car that keeps failing can earn a repair waiver, but the state wants $1,176 or more spent on qualifying repairs first (applications dated 2026 onward), and diagnosis time is excluded. For a car not worth that much work, see failed emissions.

Selling it under Illinois rules

McHenry County plays no part in titles. Crystal Lake owners use the Illinois Secretary of State, by mail to Springfield or at its local facilities.

The state's checklist for a seller is short:

  1. Unbolt the plates. You keep them. The buyer can't drive on them.
  2. Sign the title over and date it.
  3. For a Crystal Lake sale, list the price and sale date on a bill of sale and note the buyer's name and street address.
  4. Send Springfield the Notice of Sale. It is printed on the title's bottom edge, and VSD 703 serves when it is missing.

No title at all? Illinois charges $50 for a duplicate on form VSD 190.

Questions people ask

Does Crystal Lake have its own junk-car ordinance?
Crystal Lake's code wasn't posted online for us to read, so the rules here come from state law. The state leaves inoperable-car ordinances to each city, which means Crystal Lake may add its own.
Does my dead car in Crystal Lake still need an emissions test?
McHenry is a testing county. Gas cars from 1996 or later join the program once they are four years old, then test every second year to match the model year.
What paperwork goes to the buyer?
The title, with the assignment area signed and dated, plus a brief sale note showing price and date. The plates stay with you, and the sale notice goes by mail to Springfield.
