East Peoria cars that sit unused

East Peoria's rule reaches further than most: it covers a car that simply is not driven. Section 9-3-13 makes it a nuisance to keep "any inoperable motor vehicle, any motor vehicle not regularly used, or any parts of a motor vehicle" where the general public can see them. A car that starts but never leaves the driveway can still draw a notice. We buy whole non-running and junk cars. You can sell the whole car as it sits, with free pickup anywhere in the US.

The seven-day notice

The city serves a written notice that describes the car. It allows "seven days from the date of service" for one of two moves: clear up the nuisance, or contest whether the car really is inoperable or not regularly used.

  • No hearing request: the code presumes the car is exactly what the notice says.
  • Hearing requested: the hearing officer has seven days afterward to put findings in writing. A ruling against you takes effect from the day it is served on you.
  • Still there seven days after that: the city may abate it the way it handles abandoned vehicles.

Repairs buy little time. A car whose repairs "are not concluded within seven days from the date of the notice" counts as inoperable anyway. For your options, see a notice to remove a car.

Abandoned, and the 60-day line

Under Section 11-9-1, a car is abandoned if disrepair keeps it off the road, or if it "has not been moved or used for seven consecutive days or more and is apparently deserted." It is against the law to leave one in plain view on land that isn't yours, and the police chief can have it removed "after a waiting period of seven days or more."

The zoning code holds a surprise. It defines an automobile wrecking yard as any place where "one or more motor vehicles not in running condition" stay outdoors for more than 60 days. On paper, then, one dead car can make a yard a wrecking yard.

Snow

Section 11-5-18 halts parking on any city street that has two inches of snow or ice once the commissioner of streets declares a snow emergency. The ban holds for 48 hours unless extended, and each declaration goes out through the news media.

Title and plates from Tazewell County

Tazewell County's offices do not issue titles. That falls to the Illinois Secretary of State, either through Springfield, which is 61.2 miles from East Peoria as the crow flies, or at a Secretary of State facility. An East Peoria seller needs the title in hand, then fills in the Assignment of Title section to the buyer. Write the odometer reading there, and both sign and print your name. A notary is nowhere on the state's seller checklist. Keep your plates; they go home with you. Once the East Peoria car is sold, promptly send the title's Notice of Sale (or a VSD 703) to Springfield. A car that will never run again can also leave on a junking certificate, which Illinois lets anyone take.

Peoria is 6.7 miles away, Pekin 8.4, Normal 30.7 and Bloomington 33.0. Statewide rules: Illinois. For a car parked a long time, see car sitting for years.

Questions people ask

My East Peoria car runs, I just never drive it. Can I be cited?
Possibly. Section 9-3-13 reaches a motor vehicle not regularly used as well as an inoperable one, if it is kept where the general public can see it.
I'm in the middle of repairs. Am I covered?
For a short time only. Once seven days pass after the city's notice with the work unfinished, the code treats the car as inoperable.
How do I contest an East Peoria notice?
Ask for a hearing before the seven days are up. Miss that window and the city presumes the notice is right. If a hearing is held, written findings follow within seven days.
