Selling a junked or disabled car in Libertyville

Libertyville's code worries about loose car parts as much as whole dead cars. Section 15-72 bars engines, bodies, parts and equipment in the open on private property "for a period of more than forty-eight (48) hours in any one (1) calendar month." A half-finished parts job in the driveway runs out of time fast. If the project is over, we buy whole non-running and junk cars. Sell the whole car as it sits, with free pickup anywhere in the US.

The rule for the whole car

The same section is stricter about a complete car. "Junked or disabled motor vehicles may not be parked, stored, or left in the open, on private property within the village" unless a lawful business on the property needs them. There is no grace period written in. Both cases, the dead car and the pile of parts, are declared "a public nuisance."

What the village notice asks

Section 15-73 says the village shall notify the person in control of the property to move the vehicle "to a completely enclosed location on the property or otherwise to remove the same from the premises." A closed garage satisfies it; a cover thrown over it in the yard does not. Parts get the same notice.

The property maintenance code in Section 6-342 points unlicensed, wrecked, dismantled or inoperative vehicles, trailers included, back to these junked-vehicle rules. It also says "each day that a violation continues after due notice has been served shall be deemed as a separate offense." Section 1-25 lets the village bring removal of inoperable motor vehicles before an administrative hearing, and unpaid fines become a debt the village can collect.

Even a working Class II vehicle stored in a residential district must be screened from every neighbor and street by an evergreen hedge at least six feet tall at planting, under Section 26-10-1. Hiding a dead car behind a fence is not what the code has in mind.

One inch of snow

Street parking is the other way a dead car gets you in trouble here. Section 23-71 makes it unlawful to park on a village street with "one (1) inch or more of unremoved snow" for 24 hours, or until the street is cleared. Public works or police can move the car, and the village can keep it until you pay removal and storage.

Title and plates in Libertyville

Lake County plays no part in titles. The Illinois Secretary of State issues them. You can mail to its Springfield office or go to a state facility.

A Libertyville seller completes the Assignment of Title on the certificate, adds a signature and the date, then hands it over with the car. The state has no separate seller form, and its seller guide names no notary. Keep your plates, write down where the Libertyville buyer lives and what they're called, and put the amount and day on a short bill of sale. Send in the Seller's Report of Sale (VSD 703) right after the sale. Once it is filed, the car is no longer on you.

If the car is headed for scrap, a junking certificate is the other route. That application goes in with the title within 15 days. With no lienholder listed, a Libertyville owner keeps the title out of the junking step. Lake County sits within the state emissions area, which concerns only a buyer planning to drive.

Questions people ask

Can I keep a disabled car behind my house in Libertyville?
Not in the open. Section 15-72 says junked or disabled motor vehicles may not be parked, stored or left in the open on private property unless a lawful business needs them. The village's notice under Section 15-73 asks you to move the car to a completely enclosed spot on the property or remove it.
I am parting out a car in the driveway. Is that allowed?
Only briefly. Section 15-72 limits car bodies, parts, motors and similar items left outdoors on a lot to 48 hours in any single calendar month.
When does snow make street parking illegal?
Under Section 23-71, it is unlawful to park on a village street with one inch or more of unremoved snow on it, for 24 hours or until the street is cleared. Cars in violation can be moved, and the village bills the owner for moving and storing them.
Does the Illinois title need to be notarized?
The state's written steps for sellers mention no notary. On the certificate, you sign and date the part marked for assignment.
