Selling a junk or abandoned car in Oak Lawn

Oak Lawn's code does not stop at the property line. Section 11-10-2 says "An abandoned vehicle on the private property of the owner or other person legally entitled to have possession of the vehicle (except repair shops and vehicle dealers) is hereby declared to be a nuisance." Your own driveway counts. We buy whole non-running and junk cars, so a car that has turned into a nuisance can go as a sale. Sell the whole car as it sits, with free pickup anywhere in the US.

Plates that ran out, plus seven days

Oak Lawn widens the state's idea of an abandoned car. Besides the usual meaning, the village adds "any unlicensed motor vehicle, or one that does not have the current annual year license attached to it, which has not been used or moved for seven (7) consecutive days." A car that runs fine but carries expired plates and has not moved in a week meets that test.

Section 8-1-3 adds a second hook. Its nuisance list includes "Inoperable or abandoned motor vehicles, whether on public or private property, not located within a garage." A garage is the one place the list leaves alone.

Who can move it, and when

  • On a highway: abandoning a vehicle, or any part of one, is unlawful.
  • On any other public or private property the public can see: not allowed either.
  • On private property: the car "may be authorized for removal by or upon the order of the Chief of the Police Department after a waiting period of seven (7) days or more has expired."

Separately, Section 11-5-11 lets police move a car off a public way when it is disabled and blocks traffic while its driver is hurt, when it is parked against posted limits, or in an emergency. Officers may also remove a car parked on private property without the owner's consent.

Repair shops and car lots

Shops and dealers get more room, but not forever. A vehicle left at a repair shop or dealership "in open view of the public for more than forty five (45) days is hereby declared to be a nuisance." Used-car dealers in the M-1 district face a tighter rule: "No junk, wrecked, or inoperative vehicles will be permitted to remain on the property for more than forty-eight (48) hours." If your car is the one waiting at a shop, see stuck at a repair shop.

Illinois rules for the sale

Oak Lawn title papers go through the Illinois Secretary of State rather than Cook County. When you hand over the Oak Lawn car, sign and date the "Assignment of Title" on the certificate. Oak Lawn sellers fill out no separate Illinois transfer form. Pull your plates, because they are yours to keep. Record the Oak Lawn buyer's name and address. Your Oak Lawn bill of sale should show the date and the amount paid. Next, an Oak Lawn seller mails the "Notice of Sale" in to the Secretary of State without waiting.

If the car is junk, the state's route is a junking certificate. With a junk vehicle in Oak Lawn, you send the title in with the application within 15 days unless there's no lienholder, and the car can never be titled again. A car an insurer totals usually becomes salvage owned by that insurer. In Oak Lawn, a car 9 model years old or older can still stay with an owner who agrees to keep it. Insurer totaled it explains the choices.

Questions people ask

Is a car with old plates in my Oak Lawn driveway abandoned?
It can be. Section 11-10-2 adds to the abandoned-vehicle definition any unlicensed motor vehicle, or one without the current annual license, that has not been used or moved for seven consecutive days. On the owner's own property, an abandoned vehicle is declared a nuisance.
Does a garage protect a dead car in Oak Lawn?
Section 8-1-3 lists inoperable or abandoned motor vehicles, on public or private property, as a nuisance when they are not located within a garage.
Is there a limit on how long my car can sit at an Oak Lawn repair shop? It has been weeks.
An abandoned vehicle in a repair shop or dealership, or on premises used with it, that sits in open view of the public for more than 45 days is declared a nuisance under 11-10-2.
The insurer totaled my older car. Can I keep it and sell it?
Illinois lets the owner keep a car 9 model years old or older after a total-loss payment, by agreement with the insurer; the same goes for hail-only damage. Otherwise the insurer owns it as salvage.
