Westfield, Indiana: old dead cars and the 30-day rule

In Westfield, an old car does not have to be on someone else's land to count as abandoned. Section 75.01 of the city code includes "a vehicle that is six or more model years old and mechanically inoperable; and is left on private property continuously in a location visible from public property for more than 30 days." A dead sedan in plain view on your own driveway can meet that test. We buy whole non-running and junk cars, and you can sell the whole car as it sits, with free pickup anywhere in the US.

Every way Westfield defines abandoned

Section 75.01 lists several kinds of abandoned vehicle, among them:

  • one "left on public property continuously without being moved for three days"
  • one on public property placed so it is "a hazard or obstruction" to pedestrians or traffic
  • one on private property "without the consent of the owner or person in control of that property for more than 48 hours"
  • one "from which the engine, transmission or differential has been removed," or that is otherwise dismantled or inoperable, "and left on public property"
  • an impounded vehicle not claimed "within 15 days of its impoundment"
  • the 30-day rule for six-year-old cars above

The street clock is the short one. Three days without moving is enough on public property.

What happens after a tow

Section 75.03 sends most removed vehicles to a storage site the city approves. The exception: when the officer estimates the car's value at "less than $100," it "shall be immediately towed to an auto scrap yard." That $100 figure is the code's own test, based on the officer's estimate.

For a car worth $100 or less pulled off private property, the city may pay the tow and the Clerk-Treasurer then bills the owner. The same section makes the Bureau of Motor Vehicles "responsible for the sale of all abandoned vehicles."

Under Section 75.04, a car whose presence in a public place is "an immediate hazard to the public safety" can be impounded on the spot. Police then send notice to the owner by certified mail within 24 hours.

Title office in Carmel

For Hamilton County we checked the BMV branch in Suite A-100 of 271 Merchants Square Drive, Carmel. In a straight line, it sits about 6 miles south of central Westfield. Call 888-692-6841. Hamilton County has no title service for Westfield owners. Westfield owners have two more options: a Partial Service Provider, or one of the BMV Connect kiosks.

The paper title is where a Westfield sale happens. Every owner on it signs and adds a printed name, and the seller fills in mileage, sale date, price and buyer. The BMV's seller list has no notary step, and its bill of sale page says no notarizing is needed. Registration, plate and new title are the buyer's to apply for, inside 45 days.

Gone missing? A duplicate through State Form 205 is $15.00, or $25 more for speed, and it voids the original. A Westfield car going to scrap can use State Form 55018, a Certificate of Authority that costs $4.00, in its place. Junk car with no title explains both.

The plates

Pull them before the car leaves. A Westfield seller keeps the plates, since Indiana won't take them back, and may put them on another car they own. Emissions testing isn't a Hamilton County issue; IDEM's program runs in Lake and Porter counties only.

Getting an offer

Westfield owners can ring (877) 421-6008 or send our short form. We come to it in Westfield, like a garage off Union Street or a side yard in a newer subdivision. Already holding a city letter? Read notice to remove a car.

Questions people ask

Can my own non-running car count as abandoned in Westfield?
Yes, in one case. Section 75.01 covers a vehicle "six or more model years old and mechanically inoperable" that stays on private property, in a spot Westfield passers-by can see from public land, past 30 days. Unlike the 48-hour rule, that clause says nothing about the landowner's consent.
Where does Westfield take a towed car that is worth almost nothing?
Under Section 75.03, if the police officer estimates the car's value at less than $100, it is towed straight to an auto scrap yard instead of a storage site. The code also makes the Bureau of Motor Vehicles responsible for selling abandoned vehicles.
How long does an impounded car have before Westfield treats it as abandoned?
Fifteen days. A vehicle impounded at an officer's request that is not claimed or redeemed by the owner or an agent within 15 days falls under Section 75.01's definition.
Is a notary part of a Westfield title transfer?
Not in the BMV's list. Sellers sign, then add the mileage, date, price and buyer information. A Westfield bill of sale doesn't have to be notarized, the BMV says. Each owner named on a Hamilton County car's title signs and prints in the seller block.
