Selling a junk car in Coralville

A month is the number to watch in Coralville. The city's definition of a junk vehicle includes one that "has not been used as an operating vehicle for a period of thirty (30) days or more", and it adds that "Mere licensing of such vehicle shall not constitute a defense". A car that quit in August can be a junk vehicle by September.

The rule in Chapter 51

Section 51.01 applies to a vehicle "legally placed in storage with the County Treasurer or unlicensed". Three things can tip it over: a missing engine or pair of wheels, no way to drive off on its own power, or that month of disuse.

Section 51.02 then makes it "unlawful for any person to store, accumulate, or allow to remain on any private property within the corporate limits of the City any junk or junk vehicle." Section 51.03 declares it a nuisance under state law and puts the blame on "the owner of or person occupying the property". Renters, that includes you. The chapter has its own exceptions section, so read it if you think yours fits.

A stripped car with no title

Coralville has a rule that helps when the paperwork is gone. Under Section 80.07, an owner "whose title certificate is faulty, lost or destroyed" may sell the car to a demolisher "for junk, without a title and without notification procedures". The catch is that the shortcut covers only a shell: no engine, two or more wheels gone, or some other structural piece missing. A demolisher here means a business licensed under Iowa Code Chapter 321H to scrap or take apart vehicles.

A complete car needs paper. The Johnson County treasurer reissues a lost title for $35.00, holds the request at least five days, and wants every listed owner's signature on it. See selling with no title.

On city streets

Section 69.09 limits parking on public property to 48 hours. Section 70.06 lets officers tow a car parked against a snow-removal ban, one left past a time limit, and one with three or more parking tickets 30 or more days overdue. The owner pays towing and storage on top of the fine.

Iowa paperwork for the sale

Iowa handles scrap sales with a junking certificate. Coralville sellers can request one themselves and sign it over, so the buyer never needs the title itself. Check the word between the names on the title: "and" needs everyone's signature, "or" needs one. Either way, take the plates off and keep them. After you sell lists the rest.

Questions people ask

My car has current plates. Can it still be a junk vehicle in Coralville?
It can. Section 51.01 says "Mere licensing of such vehicle shall not constitute a defense to the finding that the vehicle is a junk vehicle." The definition itself covers an unlicensed car, or one in storage with the county treasurer, is junk once it has gone 30 days without being driven, or if it has no engine, is short two wheels, or cannot drive itself.
I rent. Who gets blamed for the junk car?
Section 51.03 points first at whoever owns or occupies the lot. Either one can be held prima facie liable.
Can I sell a stripped car in Coralville without a title?
Sometimes. Section 80.07 lets a Coralville owner with a faulty, lost or destroyed title sell a car as junk to a licensed demolisher when it lacks an engine, two wheels or a structural part. No title or notice process is needed. A whole car needs a $35.00 replacement title first.
