Selling a junk car in Council Bluffs

Council Bluffs sits in the Omaha, NE-IA metro, so a car here may carry a Nebraska title as easily as an Iowa one. That matters at the end, because Iowa handles scrap cars through a junking certificate, and Iowa issues one when "the prior foreign title shows the vehicle was junked." Other states' titles are covered in our out-of-state title guide.

The city code, and what we used instead

Our search did not find Council Bluffs' ordinances posted online. What follows is state law, which covers every Iowa town. Council Bluffs could layer local limits on top, for yards or driveways, so confirm with the city before leaning on these alone.

When Iowa calls a car abandoned

Iowa Code 321.89 gives the tests:

  • Public ground: over 24 hours without plates, or missing two or more wheels or parts.
  • Private ground: more than 24 hours parked unlawfully or dropped off without permission.
  • Impound lot: ten days unclaimed after a police tow, or sooner if police begin the notice process.

Once notified, the owner has ten days to cover towing, preservation and storage and claim the car. Silence is read as a yes to an auction or a demolisher. Our towed or impounded guide covers weighing those costs.

Iowa Code 321.90 gives commercial garages a similar route: certified mail, then ten days, and a car parked past its agreed stay is abandoned.

Pottawattamie County paperwork

Pottawattamie County's treasurer is the Iowa office for this. Under Iowa Code 321.52, a junk buyer has 30 days to give up the endorsed title and request a junking certificate, which costs nothing. A seller may apply instead and endorse the certificate across.

On an Iowa title, the reverse takes your signature, the buyer's details and the date; the buyer also needs the registering county and expiry. Late models, nine model years or newer, add a mileage statement. Your plates leave with you.

A missing or defective Iowa title has a fallback: under Iowa Code 321.90, police can approve a sale to a demolisher.

Questions people ask

Does Council Bluffs have its own junk-car ordinance?
We couldn't find the Council Bluffs ordinances, so these rules are from state law. The city may have extra rules, so it pays to phone City Hall.
When does Iowa call a parked car abandoned?
Iowa Code 321.89 sets a one-day line. Past 24 hours, a plateless or badly stripped car on public ground is abandoned, and so is a car on someone's land without permission.
My junk car has a title from another state. Can it still be junked in Iowa?
Iowa issues a junking certificate when the prior out-of-state title shows the vehicle was junked. For other out-of-state titles, our guide to an out-of-state title covers the steps.
