Selling a junk car in Hutchinson

We could not find a Hutchinson junk-car ordinance, so this page leans on Kansas law. The city may still add rules of its own. The state does set a ceiling. Under K.S.A. 12-1617e, an order to clear a nuisance car from private property allows the owner 10 days at most, with extensions for an owner showing due diligence.

How a Kansas city clears a junk car

The statute lets "any city" abate a motor vehicle found to be a nuisance on private property. Orders go out by certified mail or personal service, and a hearing is the owner's right. Ignore that order and Hutchinson removes the car, sends the owner a bill payable in 30 days, or adds the cost to the property.

After removal, the car goes through the same impound, notice and auction steps the state uses for abandoned cars. That is why the details of Hutchinson's own ordinance matter, and why we suggest calling the city before a car has sat long enough to draw a letter. See notice to remove a car.

On the street, and on other people's land

  • 48 hours. Kansas lets a public agency impound a car left 48 hours on a public highway or ground the public uses, or sooner when it obstructs highway work.
  • Unclaimed cars. After 30 days in impound, a certified notice goes to the last owner. Newspaper notices follow, and the car can then be sold at auction for cash.
  • Trespass. Under K.S.A. 8-1102(b), leaving a car on land that you and the car's owner neither own nor lease counts as criminal trespass.

Reclaiming an impounded car takes proof of valid registration and ownership.

Reno County title, liens and plates

Hutchinson cars are titled through Reno County, and Kansas has you appear in person at the treasurer's motor vehicle office. The Division of Vehicles lists the seller's entries on the title's back: sale price, sale date, mileage, then each seller's and buyer's printed name and signature. Its warning is blunt: a title that isn't fully assigned should never leave your hands.

A lien adds a step. The buyer has to file a lien release with the application. It can be printed on the title, done on a notarized TR-150, or come as a letter from the lender. If the title is electronic, the seller must give the buyer that release or a clear paper title. Lien paperwork is the only place Kansas wants a notary. See lien still on the title.

The plate goes home with you, since state law ends the registration at the sale. Moving it onto a different car costs $1.50; turning it in closes your record and makes the TR-216 unnecessary. State details are on our Kansas page.

Questions people ask

Does Hutchinson have its own junk-car ordinance?
We could not locate its code, so there is nothing to quote. Any Kansas city may take a nuisance motor vehicle off private land, so Hutchinson could have rules of its own. If a notice arrived, call the city.
How long does a Kansas nuisance order give me?
State law caps the order at 10 days, with extensions when the owner is working on it with due diligence. It arrives by certified mail or personal service, and the owner may request a hearing.
There's still a loan on my title. Can I sell?
The buyer needs proof the loan is released. For a Hutchinson sale, it may appear on the title, on a notarized TR-150, or in the lender's letter. If the title is electronic, hand the buyer that release or a clear paper title.
