Selling a dead or junk car in Baton Rouge
Emissions testing is not going away in East Baton Rouge Parish. Louisiana retires its yearly sticker for most personal cars on Jan. 1, 2027, but this parish is one of five where the emissions test stays. That sets Baton Rouge apart from most of the state for an older car that cannot pass a test. If yours has failed, stopped running or just sits, we buy whole non-running and junk cars. Sell the whole car as it sits, with free pickup anywhere in the US.

What changes in 2027, and what does not
Act 701 (HB 1085, 2026) swaps the sticker on most personal cars for a $6 QR code linked to the registration. Per the news report on the signed law, officers write no tickets for a missing sticker between June 30 and the switch. Federal law keeps the emissions test in place here and in four neighboring parishes: Ascension, Iberville, Livingston and West Baton Rouge. If emissions is what grounded your car, see failed emissions.
How Baton Rouge police treat an abandoned car
The local document we read is the police department's General Order 261, "Abandoned or Inoperative Motor Vehicles," marked "Reviewed 3/20/25." It sets out when officers treat a car as abandoned and what they do next. Two lines matter to anyone whose car is parked on another person's land:
- "It is the property owner's option to have the vehicle towed by private tow."
- "If not, the investigating officer shall call an unspecified wrecker to tow the vehicle."
The order also says the owner of the property "and/or the vehicle shall abate the nuisance by (1) removing the nuisance." Selling the car and having it hauled away is one way to get there before a wrecker does.
State law fills in the clocks
Louisiana's statutes set the timelines that apply inside the city:
- 24 hours. When police find a vehicle abandoned, they post a notice on the windshield. If it is not moved within 24 hours, the city, the parish or its tow operator removes and disposes of it under the Louisiana Towing and Storage Act.
- Three months. A car held by a city or parish for illegal parking or abandonment and left unclaimed for three months or more is treated as abandoned to it. Certified letters go to the owner within ten days of seizure and again at three months. Next it is appraised and advertised three times within ten days, and the highest bidder gets it; an owner or lienholder has a year to claim the money.
- Expired registration. An officer who stops a car with an expired registration may impound it and make the driver buy the license and register at once. The added penalty equals a quarter (25%) of what the license or registration costs for a year.
State law also lets parishes and municipalities write their own junk-car ordinances, so the city-parish may have rules beyond these. Already towed? Read towed or impounded.
Title and plate when you sell
East Baton Rouge Parish has no role in titling. Paperwork is handled by the state OMV, either at one of its own locations or a Public Tag Agent, or mailed to headquarters. You have to sign the assignment in front of a notary. In Baton Rouge, a bank officer can stand in for a notary only when a lien is recorded during the transfer.
Your plate stays with you. Remove it and cancel it, or shift it to a different car for the $3.00 license transfer fee. Cancel the plate first and the insurance second. Then report the sale: state law gives a seller fifteen days to notify the OMV in writing, and the online Notice of Vehicle Transfer flags your record. Ownership does not legally change until the buyer applies for title, and the buyer has 40 days from purchase to file the Vehicle Application, DPSMV 1799, before penalty and interest start.

Questions people ask
- Will Baton Rouge still have emissions testing after 2026?
- Yes. The yearly sticker ends for most personal cars on Jan. 1, 2027, but federal law keeps emissions testing in East Baton Rouge Parish, along with Ascension, Iberville, Livingston and West Baton Rouge.
- A stranger's dead car is parked on my Baton Rouge lot. Who has it towed?
- Under the police department's General Order 261, "It is the property owner's option to have the vehicle towed by private tow." If the owner does not, the order says the officer "shall call an unspecified wrecker to tow the vehicle."
- Police tagged my car as abandoned. How much time is there?
- Louisiana law gives 24 hours from the windshield notice. After that, the city, the parish or its tow operator can remove and dispose of the car under the Louisiana Towing and Storage Act.
- What happens to the license plate after a Baton Rouge sale?
- It stays yours. Take it off and cancel it, or put it on a different car for the $3.00 license transfer fee. Do the plate cancellation first, then end the insurance.
