Selling a dead or junk car in Dracut

A Dracut car parked at a repair shop can end up sold by the shop. Under M.G.L. c. 255 s. 39A, a Dracut garage holding a car must mail its rates to the registered owner, sent registered with a return receipt. Sixty days after the car came in, if nobody has claimed it, the garage may give notice, and 21 days after that it may sell. When the shop's repair estimate tops the car's value, make your call soon. We buy whole non-running and junk cars, you sell the whole car as it sits, and pickup is free anywhere in the US, straight from the shop if that's where it is.

How a garage sale works under state law

The sale has conditions. Before any sale, a Dracut garage needs its notice in a local paper for "three successive weeks" plus 5 days' notice to the police chief. With that done, a Dracut garage may sell the car publicly or privately. It takes what it's owed out of the money, and the leftover goes to the registered owner or to the clerk of the district court. Storage fees keep growing meanwhile, which is why a Dracut owner usually keeps more say by selling first. See stuck at a repair shop.

Dracut's own rules

No online copy of Dracut's town code turned up, so this section rests on Massachusetts law. Dracut may have bylaws of its own on unregistered or junk cars, and Town Hall can confirm before a dead car winters in the yard. Under c. 90 s. 22C, a Dracut street officer may remove a car as trash once it looks abandoned, has stayed on land over 72 hours without permission, and costs more to move than it is worth.

When the insurer totaled it

A total-loss car in Massachusetts gets a salvage title, and that brand never comes off, so no clear title can follow. The main brand reads repairable (REPR) or parts-only (PART). PART means the car may never be registered in Massachusetts again. REPR allows registration only after the car passes the RMV's salvage inspection. A Dracut title also carries a second brand naming the cause, which is one of Theft, Vandalism, Collision, Fire, Flood, Flood/Salt or Other. Dracut owners file the salvage-title papers within 10 days of the insurance settlement, or of the event itself when no insurance paid. The rule skips any passenger car that was 10 or more years old at the time of the loss. See salvage title.

Title and plates

Chapter 90D, section 15 says a Dracut seller must give the buyer a signed title assignment, an honest odometer reading and a warranty of title. Per the RMV, both of you also print names and date the block, and its seller steps list no notary. No price box? In Dracut, the price then goes on a bill of sale.

After that, cancel the Dracut registration online and keep proof for your insurer. The plates are yours, not the RMV's: destroy them by cutting, or recycle them. Once you've signed and delivered, the same statute says later violations are not on you.

Questions people ask

My car has been at a Dracut garage for months. Can the garage sell it?
Under c. 255 s. 39A, a Dracut garage starts by sending the registered owner a registered letter with its storage rates. After 60 days with nobody claiming a car, a Dracut garage may send notice. 21 more days must pass before a Dracut garage sells. For Dracut, the notice appears in a newspaper for three straight weeks, and the chief of police gets 5 days' notice.
Is anything paid to me if the garage sells it?
The garage takes its charges from the sale price. Once a Dracut garage takes its charges, the leftover money is paid to the registered owner, or failing that, to the clerk of the district court.
Can a totaled car be registered again in Massachusetts?
A REPR car can, after passing the RMV salvage inspection. A PART car never can. Passenger cars 10 or more years old at the time of loss skip the salvage-title process.
