Selling a dead car in Marblehead

Massachusetts' junkyard law, Chapter 140B, is aimed at junkyard businesses, not at a Marblehead household with one car that quit. We could not locate Marblehead's own bylaws online either, which leaves room for a town rule about stored cars that this page cannot cover. What the state does pin down is who may tow a car off private land, how the title changes hands, and what becomes of the plates. When you want the car gone, We buy whole non-running and junk cars, so you can sell the whole car as it sits.

Towing a car off private land

With 20,583 residents packed on 4.379 square miles of land, a dead car in Marblehead on rented or shared property soon leads to the question of who is allowed to move it. M.G.L. c. 266 s. 120D gives the answer. Removal is lawful only after the person in lawful control has warned the driver off, with a posted sign or face to face, and the police have been informed. Towing without that notice, or without the owner agreeing, can bring a $100 fine at most.

On private-property tows, the RMV's automobile law page points Marblehead owners to local police guides. That makes the town's police the right first call before anyone hauls a car out of a lot you do not control.

How the title gets signed

The RMV wants the seller to state the odometer reading first. Next, you and the Marblehead buyer each sign the transfer part, hand-print your names and fill in the date. A Marblehead title with a price line takes the price there. If there isn't one, the Marblehead buyer sends a bill of sale showing the price along with the application. A notary is absent from the steps. Our bill of sale guide lists what to put on one.

When the record already says Junked

Some cars reach the end with a status already on file. Junked, in RMV terms, marks a car as incapable of operation and scrapped, and no title or registration can follow it. A parts-only (PART) salvage brand, applied by the insurer that totals a car, likewise bars it from ever being registered in Massachusetts.

Cancel first, plates second

Marblehead sellers keep their plates. Cancel the registration through a MyMassGov account and hold on to the cancellation receipt; the RMV suggests your insurer get a photocopy. Once it is cancelled the car is off limits on every public way, so cancel after the car is gone or loaded on the truck. Finally, cut the plates through or recycle them. The RMV does not ask for them back.

Questions people ask

Does Marblehead have a rule about dead cars at home?
We could not locate Marblehead's bylaws online, so a town rule we never read may exist. At the state level, the junkyard statute, c. 140B, governs junkyard businesses rather than a homeowner's idle car. Ask the town before counting on that.
Who is allowed to tow a car off my driveway or lot?
M.G.L. c. 266 s. 120D lets a car be towed off private property only if the person lawfully in charge warned the driver off, with a posted sign or face to face, and the police are informed. A tow done without that warning or the owner's consent can draw a $100 fine at most.
May I drive the car once the registration is cancelled?
No. A cancelled registration means the car is barred from every public way in Massachusetts, so cancel once the car has left or is on the truck.
My title shows Junked. What does that mean?
Junked means the RMV records the car as incapable of operation and scrapped, and that status is final: no title or registration can follow it.
