Selling a dead or unregistered car in Westborough

Westborough puts its junk-car limit in the zoning bylaw, and the line is drawn at one. Article 7 says "No person shall permit more than one unregistered motor vehicle or trailer or major parts thereof" to "remain ungaraged on his premises at any time." A second unregistered car in the driveway, or a dead trailer next to one, crosses it. If one of them has to go, we buy whole non-running and junk cars. You sell the whole car as it sits, and there is free pickup anywhere in the US.

What the zoning line covers

Registration is the test here, not whether the engine works. Expired plates put even a healthy car into the count. A registered car that will not start stays out of it, at least under this line.

Trailers count the same as cars. So do "major parts thereof," which suggests a body shell or a pulled drivetrain can count against the limit as well. The word "ungaraged" is the way out: a car parked in a garage is not part of the count.

Two groups are exempt: "farm vehicles," and anyone holding "a Class 1 or Class 2 license for sale of motor vehicles." Everyone else is held to the one-car limit.

No clock in the section we read

The part of Section 7.5 quoted to us sets the limit but gives no notice period and no fine. Ask the town how it enforces the rule before you count on time to fix it.

State law does have a clock for cars left on someone else's land. Under M.G.L. c. 90 s. 22C, a Westborough car that is "apparently abandoned" can be taken by a street officer after it sits "more than 72 hours" on a street, a private way, or someone's land without consent. It also has to be worth too little to cover hauling and disposal.

If a stranger's dead car is on your Westborough lot, c. 266 s. 120D spells out when a tow is allowed. A Westborough property owner who wants a car towed calls police first. The driver also needs a warning, face to face or on a posted sign. Fines reach up to $100 for skipping the call or towing without the car owner's consent. Car abandoned on your property has more on that case.

Cancel the registration, keep the plates

Your plates leave with you, not with the car. Once the car is gone from Westborough, cancel its registration on MyMassGov and keep the receipt, with a copy mailed to your insurer. Cut the plates through the middle or drop them at recycling.

Order matters here. From the moment of cancellation, driving that car on any Massachusetts road is off the table. Even a revoked registration keeps the excise running until it is cancelled, so do not leave it hanging.

Buying a replacement? Westborough owners 18 or older can move the plates to the new car within 7 calendar days after the old one is gone. There are no RMV temporary plates to bridge a gap.

At the sale itself

You state the mileage. On the title's transfer section, both you and the Westborough buyer sign, print your names by hand and write the date. The sale price is written in the title's price space; a title with no such space means a bill of sale stating the price. The RMV's seller steps list no notary.

The rest falls to the buyer. Their application for title and registration has to carry the stamp and signature of a Massachusetts insurance agent. Westborough buyers get 10 days to title the car. The Westborough buyer pays 6.25% sales tax and $75 for the title.

Call (877) 421-6008 or go online and give the model, year and mileage, if it still runs, and whether the registration is active or lapsed. Driveway or garage, the truck picks the car up there.

Questions people ask

What is Westborough's limit on unregistered cars?
Just one may stay outside a garage on your premises at a time, and that count includes trailers and major parts. Farm vehicles are exempt, and so is anyone with a Class 1 or Class 2 license to sell vehicles.
Does a car in my garage count toward the limit?
No. The bylaw speaks of vehicles that remain ungaraged, so one kept in a garage is outside the count.
Should I cancel the registration before the car leaves?
Cancel it once the car no longer needs to move on its own wheels. A cancelled registration means the car may not be driven anywhere on Massachusetts roads. With a non-running car sold whole, the truck tows it, so that is no obstacle.
