Lincoln Park junk and non-running car sales

Lincoln Park asks for paperwork before a dead car can even sit. Section 484.03 says "No person shall park, and no owner of property shall permit the parking of, any inoperable vehicle on any property without first obtaining a permit therefor," and the application goes to the City Clerk "within twenty-four hours after any inoperable vehicle has been parked in the City." If a permit sounds like more trouble than the car is worth, we buy whole non-running and junk cars. You sell the whole car as it sits, and pickup is free anywhere in the US.

What Lincoln Park calls inoperable

Lincoln Park's Section 484.01 reaches past cars that won't start. It calls a vehicle inoperable when "currently not capable of being started and safely and properly operated on the highway," and the definition "includes vehicles that are not properly licensed for operation on the highway." A car that runs fine but has lapsed plates may still need the permit.

The permit, the tag and the 10 days

On the clerk's form you list the car's make, model and year, its last license, and why it no longer works. A permit comes with conditions. If it is revoked, notice goes to the permit holder or is posted on the car, and "The permittee shall remove the vehicle within ten days after receiving such notice or after the notice is posted."

Section 484.02 adds a second clock: an inoperable car may not stay on private property more than 48 hours "after being tagged or otherwise designated as inoperable by the Police Department or its agent."

One way around all of it: the permit section "shall not apply to a vehicle completely housed within a garage concealing such vehicle from view."

Fixing it at home instead

The zoning code, Section 1294.15, limits home repairs in residential districts:

  • A job that runs past 48 hours, or keeps the car immobile that long, must be done "within an enclosed building."
  • "Inoperable vehicles, vehicle parts, equipment, tools, and supplies shall be stored within an enclosed building."
  • Only vehicles of immediate family living at the address may be worked on or stored there.

Business-district parking lots offer no refuge either. Section 1290.05 caps any one stay in an off-street parking B area at 48 hours.

If it lands in the city pound

Section 422.02 charges storage of $2.00 a day, or part of a day, starting 48 hours after the car goes in. Nobody may take the car out "until all storage charges levied against the motor vehicle have been fully paid."

Title and plate in Michigan

Lincoln Park titles are not a Wayne County job. The Michigan Department of State issues them at its Secretary of State branch offices. The original title goes to the buyer. You complete the odometer statement and the seller's section, then you and any co-owner sign. Those seller steps list no notary.

State records list you as owner until the buyer does the transfer. That is the reason the Secretary of State says to visit a branch with the buyer. If not, Lincoln Park sellers keep a signed title copy, or a note with the buyer's details, price and date, for 18 months or more.

Michigan law says plates are "removed and retained by the owner." In Lincoln Park, they can go on another car you own. A spouse, parent, sibling or child who takes the car can get them too.

Questions people ask

Do I need a permit for a car that won't start in Lincoln Park?
Yes, unless it is completely housed in a garage out of view. Lincoln Park's Section 484.03 bars parking an inoperable vehicle on any property unless it has a permit. The request goes to the City Clerk within 24 hours of the car being parked.
The plates lapsed but the car still runs. Does it count as inoperable?
Under Section 484.01 it can be. Lincoln Park's definition covers a car that can't be started and safely driven on the highway, and it includes vehicles not properly licensed for the road.
What does the Lincoln Park pound charge for storage?
Section 422.02 sets city storage at $2.00 a day or part of a day, starting 48 hours after the car goes into the pound. Nobody may take the car out until every storage charge is paid.
