Selling a dead car in Brandon

Brandon's code names the parts. Under Section 66-1, a vehicle is junked or abandoned when it is "incapable of being moved under its own power" or "rendered inoperative by reason of the lack of essential parts, such as wheels, motor, radiator, or other essential components." A Brandon car up on blocks, or one whose radiator came out for a repair that stalled, fits. We buy whole non-running and junk cars, missing pieces and all. You sell the whole car as it sits.

Section 66-9

Keeping junked vehicles on a residential or nonpermitted business property in Brandon is against the law under Section 66-9, which also labels the practice "a public nuisance." Antiques sit outside the definition. Neither section we read gives a grace period or a notice deadline, so do not count on a set number of days.

Brandon yard parking

Section 7.11 of the zoning code is strict in residential districts:

  • Front and side yards: a vehicle belongs in a garage or carport, or on an apron or driveway. Unplatted RR-zoned land has an exception outside the minimum yard area.
  • Rear yards: allowed only if the vehicle "will not be visible from the street and/or neighboring property," or under that same RR exception.
  • Commercially zoned lots: outdoor parking only on a paved driveway or paved parking area.

So a broken sedan resting on the lawn beside the house runs afoul of Section 7.11 before anyone asks whether it is junk.

Selling from the curb

Per Brandon's zoning standards, "No person shall park a vehicle upon any roadway for the principal purpose of displaying such vehicle for sale." A dead car wearing a for-sale sign belongs off the street.

Repair-shop cars in Brandon

The same zoning section makes repair businesses screen the cars they accept from view, and it also says "No partially dismantled, wrecked, or unlicensed vehicle shall be stored outdoors on the premises." State rules cap how long you can leave one there. Once the agreed pickup date passes, or 40 days go by, the car counts as abandoned. The shop then has 7 days to notify you and any lender, and if 30 days pass with no claim it may sell or destroy the car. Read stuck at a repair shop before that clock runs.

Rankin County paperwork

A scrapped, dismantled or destroyed car in Mississippi gets a Junked Certificate of Title, issued when the owner hands over the regular title (Miss. Code Ann. 63-21-39). For an ordinary sale, the seller handles the assignment and leaves only the buyer's printed name and signature for the buyer. The buyer's name must never be left empty; DOR says that breaks state law.

The plate is yours to keep in Brandon; it does not go with the car. Unbolt it before the truck leaves and bring it to the Rankin County Tax Collector. Any unused tag credit counts from when the Tax Collector gets the plate, and it works in every Mississippi county.

Questions people ask

My car is missing its radiator. Is it junked under Brandon's code?
It can be. Section 66-1 covers a vehicle made inoperative by missing essential parts and gives wheels, motor and radiator as examples. Antiques are excluded.
Where in a Brandon front yard may a car be parked?
In residential districts, Section 7.11 allows a front or side yard vehicle only in a garage or carport or on an apron or driveway, with an exception for some RR-zoned land outside platted subdivisions.
Is it legal to leave a car on a Brandon street to sell it?
No. Brandon's zoning rules bar leaving a car on a roadway mainly so people can see it's for sale.
