Selling a dead or junk car in Kalispell

On a Kalispell street, a car that sits three days is in storage. Section 17-77 says "Any motor vehicle not used at least once every 72 hours shall be deemed to be stored in violation hereof." A car that does not run, or is not registered in Montana, puts its owner in a worse spot: "deemed prima facie guilty". The code lets you rebut that only by showing the car "had just broken down" and you had not yet had time to move it, or by a showing about its registration. For a car that can't move itself off the street, we buy whole non-running and junk cars. You sell the whole car as it sits, and pickup is free anywhere in the US.

On private property: ten days after notice

Section 19-36 covers junk vehicles on private land. Its definition reaches beyond whole cars to "Any identifiable part of a discarded, ruined, wrecked, or dismantled motor vehicle", and it lists "fenders, doors, hoods, engine blocks, motor parts, transmissions, frames, axles, wheels, tires". An engine block on a pallet behind the shop counts.

Inspections are made "at reasonable intervals" by the City Manager or a designee, and written notice goes to the occupant, or to the owner when the place is empty. You then "shall have 10 days after the service of such notice within which to comply". If the car has stopped starting for good, car doesn't run lays out the choices.

Why a storage unit is not the answer

Moving a dead car into a rented unit seems like a fix. Kalispell's zoning code closes it off. Section 27.34.090 says its storage rules "shall not be interpreted to permit the storage of partially dismantled, wrecked, or inoperable vehicles." It also bans repairing a motor vehicle inside any mini-storage or RV storage building. A project car can't move there to wait.

Selling it under Montana rules

The seller's part is short:

  • No notary. Montana dropped that requirement on Oct. 1, 2025.
  • Sign in blue or black ink. A Kalispell title with white-out or lines struck through is no longer valid.
  • Write in the buyer's name and address.
  • On a vehicle newer than nine years, complete the odometer disclosure.

Then pull your plates. MCA 61-3-334 requires it as soon as the car changes hands, and the MVD warns that plates left on can tie you to later tickets. Kalispell sellers file no sale notice with Montana. Once the title is signed, Kalispell sellers should make a front-and-back copy and keep it.

Questions people ask

Can I leave my broken car parked on the street in Kalispell?
Not for long. Section 17-77 deems any car not used at least once every 72 hours to be stored in violation, and leaving a car that does not run or is not registered on the street makes you prima facie guilty. The code allows a rebuttal only in narrow cases, such as a car that had just broken down.
Is it OK to keep a dead car in a mini-storage unit?
Section 27.34.090 says its rules may not be read to allow storing partially dismantled, wrecked or inoperable vehicles at mini-storage or RV storage facilities, and it bans repairing a motor vehicle inside them.
What deadline comes with a Kalispell junk-vehicle notice?
Ten days after the notice is served, under section 19-36.
