A nonoperational car in Garden City

Garden City puts a calendar on a broken car. Under Section 193-45, a car that cannot lawfully be driven turns "nonoperational" once that has lasted more than "(a) 60 consecutive calendar days, or (b) an aggregate of 90 days within any six-calendar-month period." From there the village gives it 90 consecutive days on any property, public or private, in a residential district. If yours is nearing those numbers, we buy whole non-running and junk cars, and pickup is free anywhere in the US.

Counting the days

The definition is broad. A car is nonoperational if it "cannot be lawfully driven upon the public streets for any reason," and the code names three: being "unlicensed or unregistered with the Department of Motor Vehicles," being "in a state of disrepair," or being "incapable of being moved under its own power." A car with a valid registration but a dead transmission counts. So does a perfect car whose registration lapsed.

The ban itself reads: "It is hereby prohibited for any person to park or store, or permit others to park or store, any nonoperational vehicle on any property, whether public or private, within any residential district in the Village of Garden City for longer than 90 consecutive days." Because of the words "permit others," letting someone else park there counts, not only parking your own car.

A second rule, in the property code at 71-14, is shorter and has no clock: "Junked or unregistered vehicles, equipment and materials shall not be stored in open areas of premises."

Three tickets and a tow

Village police may remove a car parked on a street, in a municipal lot or on other village property once "three or more delinquent parking tickets" have been issued to it or to its registered owner. To get it back, the owner pays every past-due ticket plus an impound fee set by the Board of Trustees.

Waiting it out does not work. Under Section 193-33, a car not claimed by its registered owner "within 10 days of the impounding" is "deemed to be an abandoned vehicle" and disposed of under state law. If the car is not worth the tickets, see towed or impounded.

New York paperwork for the sale

A Garden City sale is done once you sign the title's seller line and the MV-912 bill of sale. Neither one needs a notary in New York. The buyer registers and titles the car at a NYS DMV office and keeps a copy of the bill of sale; so do you.

For a lost title, Form MV-902 brings a duplicate for $20. For a car at least eight model years back whose value does not pass $1,250, Form MV-35 lets the owner skip the title, provided the buyer is a dismantler, scrap processor or itinerant collector holding the state's registration or certification. That car is scrapped for good. Model year 1972 and older cars never had a New York title; the registration transfers instead.

Turn in the plates first

Remove the plates and the windshield registration sticker before the car leaves. Hand them in, or reuse them on another car you own, before you cancel the liability policy, and keep the FS-6T receipt. A registered car with no insurance draws a DMV letter and can lead to suspension. After you sell covers what else to close.

Getting an offer

Call (877) 421-6008 or fill in the request. Let us know its model, year and miles, if the engine comes on, and if you hold the title. A driveway, a garage or a repair bay can all serve as the pickup spot. Mineola is 1.5 miles away and Hempstead 2.0; statewide rules are on New York.

Questions people ask

In Garden City, how long may a broken car stay in my driveway?
A car becomes nonoperational under Section 193-45 once it cannot lawfully be driven for more than 60 consecutive days, or 90 days in total within six months. From then on, it can't sit parked or stored on public or private property in a residential district past 90 consecutive days.
Does an unregistered car count as nonoperational?
Yes. It covers a car that has no license or registration, is in disrepair, or can't drive itself anywhere.
What happens to a car impounded for unpaid tickets in Garden City?
If the registered owner, or someone authorized in writing, does not claim it within 10 days, the village treats it as abandoned and disposes of it under Vehicle and Traffic Law 1224.
