Selling a junk car in Spring Valley, title or not

A Spring Valley owner who lost the title, or never got one, may still be able to sell an old junk car legally. A Spring Valley seller can use Form MV-35 once the car reaches eight model years or more and is worth $1,250 or less. There is a catch. Only a business with DMV registration or certification to take cars apart can buy it. After that, the car can't be titled again.

What MV-35 allows, and what it doesn't

The DMV's no-title form has firm limits:

  • Who signs it. The owner, and only the owner. That means a Spring Valley buyer who never titled the car, or someone whose title went missing.
  • Who it can go to. Dismantlers, itinerant vehicle collectors and scrap processors with state registration or certification. A neighbor buying it privately is out, and so is a tow driver with no license.
  • Which cars qualify. Eight model years old or more, and no more than $1,250 in value.
  • ID. The owner and whoever delivers the car each attach government ID.
  • Deadline. The dismantler files within 15 business days.
  • Afterward. In the form's words, it "may never be titled again." Dismantling or scrap is the only future it has.

Behind all this sits Vehicle and Traffic Law 415-a. Spring Valley parts and scrap buyers must hold a DMV dismantler registration. Running that trade without it is a class E felony.

Newer or worth more

If the car fails either test, the way forward is a replacement title on Form MV-902, which costs $20.00. Spring Valley owners can file online, at an office, or by post with a copy of their ID. Albany does the printing and mails it out. Selling with no title lines up the other routes.

Older than titles

New York never titled cars from model year 1972 and earlier. Those pass by handing over the transferable registration. So an old sedan in a Spring Valley garage changes owners on its registration, with no title involved. See old project car.

Finishing a sale with a title

Sign the assignment area on the reverse of the title, then the MV-912 bill of sale. Neither gets notarized. Unbolt the plates and peel the registration sticker off the glass before the car rolls away. Spring Valley plates should be back at the DMV or on the next car while insurance is still active.

Local rules

Spring Valley's village code didn't turn up online. State law gives villages the say over junk cars on private land, so local limits may exist. Out on the street, the state's abandoned-car law, VTL 1224, kicks in once a car has been left in public for longer than a day.

Questions people ask

Who can buy a junk car on Form MV-35?
Only businesses the DMV has registered or certified to take cars apart or scrap them: dismantlers, itinerant vehicle collectors and scrap processors. A private buyer cannot use it, and neither can an unlicensed tow-truck driver.
My car is from model year 1972 or earlier. Where is its title?
There never was one. For cars that old, New York moves ownership on the transferable registration instead of a title.
What happens to a car sold on MV-35?
Its titled life is over. The car has to be dismantled or scrapped. The dismantler gets 15 business days to file.
