Selling a dead or junk car in Oxford

Current plates do not protect a broken car in Oxford. The city's zoning rules give a car with current plates that won't run one week parked outdoors, unless it is kept in an enclosed garage or other accessory building. A car without current plates has its own clock: seven days after Oxford police put a notice on it.

Two rules for a car that won't run

Plated but not running. Section 1141.04 caps outdoor parking of an inoperative vehicle that has current plates at one week. The same section bans outdoor storage of junk, salvage and parts, used tires included, anywhere in the city except an authorized junk yard. Once notified, you have ten days to resolve either problem, or it is declared a nuisance. Every further 30 days counts as another violation.

Unlicensed and dead. Section 303.09 covers a car with no current license that is nonoperating, wrecked, partially dismantled or abandoned, whoever owns it. The Oxford Police Department places a removal notice on the car, and the person in control of the property then has seven days. A car in an enclosed building is exempt, and so are commercial garages, repair shops, used car dealers and lawful junk yards.

A first violation of 303.09 is a minor misdemeanor. With one predicate traffic offense in the past year it becomes a fourth-degree misdemeanor, and with two or more, third-degree.

What counts as inoperable is broad. Oxford's property maintenance code casts a wide net, and its examples include "being unlicensed, wrecked, abandoned, in a state of disrepair or incapable of being moved under its own power."

Street parking and snow

Section 351.13 sets a 72-consecutive-hour ceiling for any car on a city roadway, and a car that overstays can be impounded or booted.

Posted snow routes are tow-away zones. Parking on them stops once snow or ice reaches three inches, and during any level of snow emergency the City Manager declares. At Level III every roadway is closed to nonemergency drivers, and a car driven anyway can be impounded under Section 303.08.

Tows and fees

The police department's citation page lists the charges for parking enforcement:

ChargeAmount
Boot$125
Impound$125
Tow$125
Storage, after the first 24 hours$15 a day

Release comes only after every citation and fee is paid. Under Section 303.08 you also appear at the Police Department to prove identity and ownership before the pound gives it up. Separately, Section 303.081 lets police order a tow from a private residential lot, on a complaint, once a car has been there four hours without the owner's permission. The department is at 101 East High Street, (513) 524-5240.

The drive to a title office

The closest Butler County title office to Oxford is in Hamilton, at 744 NW Washington Blvd., and it is about 9.7 miles southeast as the crow flies; call (513) 887-3090. The county's office at 315 High St. in Hamilton is about 12.3 miles away, and the Wessel Dr. office in Fairfield is about 15.2 miles, both also to the southeast.

Whoever sells signs the title in a notary's presence; Ohio insists on it. No title at all? Apply for a replacement (form BMV 3774) before selling. The plates are yours to remove when the car is sold, because Ohio ends the registration with the sale.

Questions people ask

My car still has current plates. Can it sit broken in my Oxford driveway?
For one week. Oxford's zoning rules bar parking an inoperative car with current plates outdoors for more than a week, unless it is kept in an enclosed garage or other accessory building. After notice, the violation has to be fixed within ten days or it is declared a nuisance.
What does it cost if Oxford tows my car for a parking violation?
The police citation page lists a $125 impound fee, a $125 tow fee and $15 a day in storage once the first 24 hours pass; a boot is also $125. The car is released to the owner only after every citation and fee is paid.
Can I park on a snow route in Oxford if the city hasn't declared an emergency?
Not once snow or ice reaches three inches. Section 351.16 bans parking on any posted snow route at that depth, and during every level of snow emergency, and the routes are tow-away zones.
