Selling a dead or junk car in Bethany

In Bethany, a stale plate can be enough. Section 96.01 lists a vehicle "bearing no state license plate or bearing a state license plate that is more than three months out of date" as a junk/derelict vehicle, right beside wrecked and inoperative ones. Leave one outside for more than 72 hours and it is an offense. Selling it stops that clock: we buy whole non-running and junk cars. You sell the whole car as it sits, and pickup is free anywhere in the US, Bethany included.

How Section 96.01 reads

The definition is wide. A vehicle qualifies if it is "wrecked, dismantled, partially dismantled, inoperative, deteriorated, decayed," needs repairs it has not had, is abandoned, or has the plate problem above.

The rule itself bans leaving one "upon any public or private property within the city for a period of time in excess of 72 hours." Your own driveway counts as private property.

The rule skips three cases: a vehicle "enclosed within a building on private property," one kept by a legal business in the right zone, and a working car made for drag strips or raceways. Repair shops get longer, but not forever. The section does not exempt cars kept outside "in excess of 30 days on the premises of a motor vehicle repair facility." If your car died at a Bethany shop, see stuck at a repair shop.

Ten days after notice

Once you are served, the code allows a "ten-day period of compliance." Should the car remain after that, with no timely hearing request on file, the City Manager may keep recommending criminal charges "on a daily basis."

In Bethany the landowner must remove it "upon proper notice and opportunity to be heard," so a renter's dead car can become the property owner's problem. When the city abates it, the City Manager or a designee assigns the vehicle a value and has it stored "for not more than 30 days."

Streets and the impound lot

Section 71.116 bars parking a derelict vehicle "upon any street or municipally-owned property." On the street, that includes a car with no current plate displayed and one that has "obviously been abandoned and left on any street." A wrecked car may stay put while police investigate the crash.

Police impound under Section 70.126. Section 70.140 hands the car back to whoever brings the order of release to the lot and pays "all impoundment costs and accrued storage charges due." If those charges outgrow the car, read towed or impounded.

Title and plates for a Bethany sale

Bethany is in Oklahoma County. The county title office we checked sits at 320 Robert S. Kerr Ave. in downtown Oklahoma City, phone (405) 713-1300, about 7 miles east of central Bethany in a straight line. Titles are also handled by Service Oklahoma and its licensed tag agencies.

You sign the title over under oath in front of a notary. The state also wants the sale pre-registered with Service Oklahoma no later than 2 business days after it happens; either side of the deal may do it. Keep the plate. It remains registered to you, the buyer never gets it, and Service Oklahoma can put it on your next car if that car is in the same registration class. Lost the title? See selling with no title.

Questions people ask

Does a car with an expired tag count as junk in Bethany?
It can. Section 96.01 includes a vehicle bearing no state plate, or a plate more than three months out of date, in its list of junk or derelict vehicles. Even with a working engine, it violates the rule once it sits outdoors on public or private property over 72 hours.
Is a Bethany garage a safe place to keep a dead car?
Yes. Bethany's 72-hour rule doesn't reach a car stored in a building on private property. A driveway, yard or carport is not a building.
How do you get a car back after Bethany police impound it?
Under Section 70.140 you take the order of release to the place where the car is held and pay all impoundment costs and storage charges that have built up.
Does a Bethany junk-car sale need a notary?
Yes. Oklahoma requires the seller's title assignment to be sworn before a notary, and the Electronic Title Bill of Sale used for electronic titles must be notarized too.
