Selling a junk car in Milwaukie

The step that protects a Milwaukie seller happens after the car leaves. A Milwaukie seller has 10 days to report the sale on DMV2U. That step pays off in law: with the notice filed and title assigned, the Vehicle Code clears a Milwaukie seller of blame for the buyer's parking, driving or abandoning. Oregon also holds the DMV-recorded owner liable for towing and disposal of an abandoned car.

Why the 10-day notice matters for a dead car

Dead cars are the ones that get abandoned. Under ORS Chapter 819, it is an offense to dump a vehicle on a highway or on any land, public or private. Whoever DMV has listed as owner gets the bill for towing and disposal. Milwaukie tows left unclaimed after 30 days go to a public auction, or the city ordinance decides what happens. Milwaukie cars valued at $1,000 or less by a certified appraiser may be disposed of. Before anything else in Milwaukie, the car gets photographed and notices reach the registered owner and secured parties.

So whoever DMV shows as owner carries the risk. Enter your Milwaukie buyer's details on DMV2U the same week the car goes.

A city split between two counties

Milwaukie lies partly in Clackamas County and partly in Multnomah. For a title that's beside the point, since the state DMV issues every Oregon title. Milwaukie's own code didn't turn up for us online, so the junk-car rules here come from state law, and local limits may still apply.

Two DMV offices we checked, with straight-line distances from Milwaukie's center (as the crow flies):

  • Lake Oswego, 3 SW Monroe Pkwy, Suite D, about 4 miles west. Phone 503-299-9999.
  • Portland Downtown, 1502 SW Sixth Ave, about 6 miles northwest. Same phone number.

The title itself

In Milwaukie, the seller signs and dates either the back of the Oregon title or a bill of sale. A lender with an open loan also signs off on it. Odometer disclosure applies from model year 2011 until a car turns 20, and both names go on it. No notary shows up anywhere in DMV's seller instructions. A Milwaukie seller missing from the title gives the buyer a bill of sale showing the VIN, a release of interest, a date, and every seller's printed name and signature.

After that, a Milwaukie buyer has 30 days to seek a title in their own name. It costs $25 more from day 31 to 60, and $50 more after that. DMV refuses a dismantler's or wrecker's bill of sale as a substitute for a real title.

Plates

Feel free to take off the plates before it is towed away. You can only switch them to a car you also own. Put them on another person's car and the rest of the registration ends on both. The rest of the wrap-up is on after you sell.

Questions people ask

How long do I have to tell Oregon DMV I sold my car?
Ten days. Enter the buyer's name and address on DMV2U. Once DMV has it and the title is signed over, the Vehicle Code stops linking you to what the Milwaukie buyer does with the car.
Milwaukie is in two counties. Does that change anything?
No. Oregon titles come from the state DMV, so Clackamas and Multnomah residents follow identical title rules. Two offices we checked are in Lake Oswego, about 4 miles west, and downtown Portland, about 6 miles northwest.
Does Milwaukie have its own junk-car rule?
We didn't locate Milwaukie's code online, so this page draws on state law instead. Milwaukie could have local limits on inoperable or stored cars all the same; a call to city hall settles it.
