Florence rules for junk cars, and how to sell a dead one

In Florence, a car can count as junk without being broken. Town Code 73.12 defines an "abandoned or junk vehicle" as one "incapable of movement under its own power" that will stay that way "without major repair or reconstruction," or "a vehicle not having a current license and registration." Expired tags alone can do it. If yours is past saving, we buy whole non-running and junk cars. Sell the whole car as it sits, with free pickup anywhere in the US.

Hidden within five business days

Florence's rule is about visibility. Section 73.12 says junk cars, and cars "being repaired or restored," must be stored in an enclosed area "in such a manner as to not be visible from any point lying outside the property." Subsection (C) sets the clock: "Vehicles must be removed within five business days and stored in an enclosed area as not to be visible from outside the property." The zoning code repeats the storage rule in Section 150.082.

The nuisance chapter widens the net. Section 93.002 covers a vehicle that is "inoperative, stripped, scrapped, discarded, wrecked, on blocks or similar devices," that is "without current license plates," or that "has deflated or missing tire(s)."

A cover is not a garage

Section 93.026 closes the obvious workaround: "A vehicle or watercraft cover is not an enclosed area." The same section requires parked vehicles to sit on a dust free surface, so a dead car on bare dirt in a Florence side yard can break two rules at once.

Public roads

Under Section 73.06, once a written notice warning of removal under A.R.S. is placed on a Florence car, it can't stay in one spot on a public right-of-way past 48 consecutive hours. 28-872. The count starts at the notice, not on the day you parked.

Lapsed registration and the next owner

Since lapsed tags are part of the town's test, back fees can come up. For a Florence car, ARS 28-5807 puts back vehicle license tax only on owners from the unregistered period. A later owner does not. See registration hold.

Title office and Arizona paperwork

The office we checked for Pinal County, 240 W Cottonwood Ln in Casa Grande, lies roughly 23 miles southwest of central Florence as the crow flies, per ADOT MVD's hours and locations page. Pinal County doesn't do titles for Florence; state MVD and authorized Third Party offices do. Florence owners can finish a lot of it online at AZ MVD Now.

  1. Sign the paper title on the back, or complete eTitle Transfer.
  2. Give the buyer the title at the moment the car changes hands (ARS 28-2058).
  3. On most 2011-and-later models, include the odometer disclosure.
  4. Remove the plate, which stays yours; within 30 days put it on another vehicle, return it, or file the plate-destruction affidavit.
  5. Send MVD a Sold Notice, free, by day 10. The Florence buyer then has 15 days to apply for a title.

After you sell covers each step.

Nearby

Queen Creek is about 16.5 miles off. Apache Junction and Casa Grande are each roughly 23 miles away. The Arizona page has the statewide rules.

Questions people ask

The tags lapsed, though my car runs fine. Does Florence call it junk?
It can. The Section 73.12 definition includes any vehicle lacking a current license and registration.
Does putting a cover on the car satisfy the rule?
No. Section 93.026 states that a vehicle or watercraft cover is not an enclosed area; the car must be hidden from every point outside the lot.
Who owes the back license tax on an unregistered car?
ARS 28-5807 says it's only someone who owned it during the unregistered time. A buyer who comes later does not inherit that bill.
