Selling a junk or dead car in Van Buren

Van Buren's code does not wait for a wreck. A car that has quit for good is enough. Section 11.28.02 calls a vehicle "abandoned" once it is "in a state of disrepair and incapable of being moved under its own power," and it bans "the open storage of any abandoned motor vehicle" on any property in the city. If yours fits that wording, selling it is one way out. We buy whole non-running and junk cars, so you can sell the whole car as it sits, with free pickup anywhere in the US.

What 11.28.02 asks of owners and renters

The section is a long list. Weeds, dead trees, rubbish and standing water share it with the dead car, which sits next to "ice box, refrigerator, stove, glass, building material." Both the property owner and the occupant answer for it. The code makes it unlawful "to fail or refuse to remove such items from the property," so a renter whose dead sedan sits out back is on the hook along with the landlord.

The clock starts with the city. Once notice to abate has gone out, "each day such nuisance is permitted to remain after notice from the City" adds to what the responsible person faces. The section text does not name a fixed number of days. Any notice that arrives will carry its own date; go by that. Our guide to a notice to remove a car walks through the choices.

The zoning chapter's own definition

Title 14 describes a problem vehicle in more detail. Under 14.04.02, a vehicle is any motor vehicle "missing a motor, transmission, tire" or one "damaged as to not safely operate on the street." It also reaches a car "partially dismantled, wrecked or deteriorating" to the point that it "creates a blighted influence on a neighborhood or street corridor." A pickup with the engine pulled matches the first clause. A sedan with crash damage and a crushed fender may match the second.

The same chapter mentions impound and holding yards, where inoperable cars waiting on an insurance adjuster or a repair shop are "kept for a period not to exceed 60 days." That 60-day cap governs those yards, not a home driveway.

Arkansas paperwork for a Crawford County sale

Arkansas keeps titles at the state level. DFA's State Revenue Offices do that work in person, and the MyDMV site handles title applications and plate moves from home. Your part as seller: endorse the title, deliver it, and sit down with the buyer over DFA Form 10-313. That one page asks for the VIN, who is buying, the sale date, what the car is, its odometer figure, the whole price, and two signatures. Nowhere in DFA's seller steps does a notary appear.

Keep your plates when the car goes. Bolting them onto your next vehicle costs $1.00 under DFA's fee schedule. DFA charges no fee for its Notice of Transfer of Ownership, and sellers may skip it. Separately, Ark. Code 27-14-911 shields a seller who truly sold and handed over the car from blame for the new owner's careless driving.

No title for a quarter-century-old car? Arkansas lets one that age go to scrap with a bill of sale (year, make, model, VIN) attached to DFA's Notice of Intent to Dismantle. Anything younger needs a replacement title, or DFA's bonded title (Form 10-345) when no other route exists; selling with no title explains.

Questions people ask

Does a car with a missing tire count under Van Buren's code?
It can. The zoning definition in 14.04.02 covers a motor vehicle missing a motor, transmission or tire, or one too damaged to run safely on the street. Section 11.28.02 aims at a broken car unable to roll on its own engine. One that never turns over fits both.
Is there a set deadline once Van Buren gives notice?
The text of 11.28.02 does not set a number of days. It says each day the nuisance stays after notice from the city counts against the person responsible, so check the notice itself for its deadline.
Does an Arkansas title transfer need notarizing?
DFA's seller steps never mention a notary. Endorse the title, deliver it, then complete Form 10-313 with the buyer; that form carries signature lines only.
