Selling a dead or junk car in Banning

Banning allows a dead car ten days. Banning's Section 10.28.140 bars keeping a car "in an abandoned, wrecked, dismantled or inoperative condition" on any public or private property within Banning "for a period in excess of ten days" unless it is fully enclosed. A third offense at one site by one person "shall constitute a misdemeanor offense," punishable by "a fine not exceeding one thousand dollars or six months in jail, or both." We buy whole non-running and junk cars, so a Banning car past day ten can leave as it is.

Banning's abatement path, step by step

Chapter 10.28 leans on state authority, Vehicle Code 22660. Banning's own findings say stored wrecks tend "to invite plundering" and "to create fire hazards." Section 8.48.340 adds that letting such a vehicle sit on your premises is itself "a public nuisance."

  • Banning sends its abatement notice through the post, registered or certified. It goes to whoever the county roll lists as landowner, and to the registered and legal owners on record.
  • Within ten days of that mailing, a written request to Banning's department of building and safety buys you a hearing. Landowners who had nothing to do with the car may submit a sworn statement saying so, rather than attend.
  • Miss that window and Banning's building and safety staff may haul the car.
  • Releases speed things up. If both owners sign them, or the car lacks its motor, transmission or wheels and is "not capable of being towed" (with other conditions met), Banning can move faster. The owner still hears before final disposal, and a car left unclaimed at the scrap yard "within twelve days after the notice to dispose of vehicle is mailed" can be disposed of.

At a hearing, Banning may assess administrative costs, attorney fees and the removal bill against the land.

Curbside in Banning: 72 hours, then 200 feet

Section 10.16.050 forbids parking on "any highway, street, road or alley for a consecutive period of longer than seventy-two hours." Section 10.12.045 adds a posted warning. The car must go "to a location more than two hundred (200) feet away" within 72 hours, or Banning removes it "at the owner's expense." Nudging it forward a few car lengths changes nothing. Impound and storage charges in Banning fall on the owner, and on whoever parked it if that is someone else.

Selling a Banning car under California rules

Titles here are state business, handled by the California DMV rather than Riverside County.

  • As a Banning seller, sign the California Certificate of Title. Any lienholder on a loan signs it too. No notary appears among the DMV's seller steps.
  • Next, send the DMV REG 138, the "Notice of Transfer and Release of Liability," online or by post within 5 days of the Banning sale. Any ticket dated after the sale goes to the buyer.
  • Ordinary plates usually ride along with the car. Recording it as Junk at the DMV is the exception; those plates are turned in.
  • Bound for wrecking or dismantling? Then California waives the Smog Check.

Lost the title? Banning owners begin with REG 227; see junk car with no title. For the insurance and plate wrap-up, read after you sell.

Questions people ask

What is Banning's limit for a broken-down car on a lot?
Ten days under Section 10.28.140, unless the car is completely enclosed. The section covers cars, licensed or not, and parts of them, on private or public property in Banning. A third violation by one person at one site is a misdemeanor, punishable by "a fine not exceeding one thousand dollars or six months in jail, or both."
Banning sent me a notice of intention to abate. Now what?
Write to Banning's department of building and safety within ten days of the mailing to get a hearing. Landowners can file a sworn statement denying responsibility in place of appearing. If no request arrives in time, the department may remove the car.
Does rolling the car a little way reset Banning's 72-hour clock?
No. After an officer posts a notice under Section 10.12.045, the car has to end up more than 200 feet from that spot within 72 hours.
Is a Smog Check needed for a Banning junk car?
For a car being wrecked or dismantled, California drops that requirement. Other sales need one from the seller unless an exemption fits, for example gas and hybrid models no more than four model years old.
