Rancho Cordova junk cars, tows and lien sales

Tow a dead car out of Rancho Cordova, leave it at the yard, and the story is not over. On a Rancho Cordova tow, California gives the towing company a lien and the right to auction the car. Any gap may then be billed to the last registered owner. Selling before any of that starts keeps the car out of that chain. We buy whole non-running and junk cars; sell the whole car as it sits, with free pickup anywhere in the US.

From tow to lien sale

Civil Code 3068.1 lets Rancho Cordova tow and storage firms keep a car until their bill is paid. Civil Code 3072 covers a Rancho Cordova car valued at $4,000 or below. The yard must start the sale within 15 days after the lien arises. Rancho Cordova storage charges can build for 60 days, and in some cases 120. Pricier cars go through Civil Code 3071 instead.

What 3072 requires, in order:

  1. First the Rancho Cordova yard mails out a Notice of Pending Lien Sale.
  2. That mailing starts the clock, and the Rancho Cordova car is sold on day 31 through day 41.
  3. A Rancho Cordova owner who files a Declaration of Opposition in 10 days has a right to a court hearing.

Let those 10 days pass and the auction proceeds. Vehicle Code 22523 then says the last registered owner of an abandoned car that was impounded and never redeemed has committed an infraction, and owes whatever deficiency the sale leaves. Our towed or impounded guide explains getting a car out.

How Rancho Cordova cars get towed in the first place

Two state rules start most of it. Seventy-two hours parked in one place on a public street, contrary to a local rule, permits a tow. Rancho Cordova counts a car as abandoned if it was dumped by a highway or left on another person's land without permission. The Rancho Cordova fine is at least $100, and you must prove someone paid for the removal.

Driveways and yards are a different matter, decided city by city under Vehicle Code 22660. Rancho Cordova's code did not turn up online, so assume the city could have its own rule.

One form ends the liability

That same 22523 spares an owner who filed a report of sale. California's version is REG 138. Rancho Cordova sellers must file it within five days of selling or otherwise giving up a vehicle. Rancho Cordova sellers mailing the form send it to P.O. Box 942859 in Sacramento. Online filing is at dmv.ca.gov/nrl. After DMV records it, the buyer is responsible for tickets and lawsuits from after the sale date.

Title, smog and plates

No Sacramento County office touches titles. A DMV field office does, or the mail. A Rancho Cordova seller signs the certificate of title, a listed lender adds a signature if there is one, and the buyer files it. Nowhere do DMV's private-sale steps call for a notary. Is the car titled to a parent or a late spouse? See car not in your name.

Smog paperwork is not needed when a car is sold for dismantling. Plain plates go with the car. State-level rules are collected on the California page.

Questions people ask

My towed car is still at a Rancho Cordova yard. Could I owe money?
Yes. When an impounded abandoned Rancho Cordova car goes unclaimed, California bills the last registered owner for whatever the lien sale doesn't cover. Filing a report of sale avoids that.
When can the yard sell it?
For a Rancho Cordova car valued at $4,000 or below, the yard sends a "Notice of Pending Lien Sale" by mail under Civil Code 3072. That Rancho Cordova sale comes 31 to 41 days later. Filing a Declaration of Opposition within 10 days puts a Rancho Cordova owner's case before a judge.
Does Rancho Cordova regulate dead cars in driveways?
Its code was not online when we checked. California lets each city write its own private-property rule, so one may exist.
