Selling a junk or dead car in DeLand

An expired tag is enough to put a DeLand car under suspicion. City Code 21-01 says "the absence of a license plate for the current year or the absence of a current motor vehicle registration shall be prima facie evidence that a motor vehicle is abandoned, junked or discarded." The car does not even have to look wrecked. If yours stopped running and the registration ran out with it, we buy whole non-running and junk cars. Sell the whole car as it sits; pickup is free anywhere in the US.

What 21-01 forbids

The rule covers "any residential, professional or commercial section of the City of DeLand." On any lot there, no one may keep "any dismantled, partly dismantled, nonoperative, or discarded personal property," and the code names vehicles, boats, parts, scrap metal and junk.

The ten-day notice, step by step

  1. Notice. The city manager can order a lot owner to remove a junked vehicle "within a period of ten days after the date that a notice to remove the vehicle is served." It comes on the city's own form.
  2. Delivery. The officer tries to hand it to the car's owner at the car. If nobody is there, it goes "in a conspicuous location on the vehicle," dated.
  3. Appeal. The notice must say the finding "may be appealed to a hearing officer appointed by the city manager."
  4. Removal. Once the ten days pass, the city can do the job and "charge, assess and collect the expense thereof against such lot, tract or parcel of land, and against the owner or owners thereof."

Unpaid tickets and body shops

DeLand also boots cars. Under Section 28-8, an owner whose cars have run up at least four unpaid parking citations gets mailed notice and no less than ten calendar days to pay. After that, a boot can go on any car registered to that owner found on a public street. Leave the boot on past 24 hours and the city may tow and hold the car until the penalties are paid.

Paint and body shops that keep wrecked or inoperable vehicles must screen them from public view under Section 33-19, with screens "at least 25 feet from any street line or setback line."

The title office is in town

DeLand drivers barely travel for title work. The tax collector's motor vehicle office at 123 W Indiana Ave., Room 103, sits roughly a mile northwest of downtown DeLand in a straight line. Phone (386) 254-4610.

  • No notary on a Florida title.
  • Seller fills in the front: buyer, miles, price, date.
  • Plate stays with you; reuse it later.
  • Leaving Florida or dropping that insurance? Surrender the plate.
  • File HSMV 82050 inside 30 days.

A car that sat with a lapsed tag

Renew a required registration after the month it was due, and Florida tacks on a delinquent fee, between $5 and $250 by tax bracket. But DeLand owners whose car sat in a garage should know about dead storage. State law skips the license tax for any period you can prove with a notarized or certified affidavit that the car was stored that way. See sitting for years.

Deltona is 9.3 miles away, DeBary 10.0 and Sanford 16.1. Each has its own code. For the state overview, see Florida.

Getting an offer

Use the form or call (877) 421-6008. Tell us about the DeLand car: model, odometer, starting or not, and the title holder. Our truck can collect it from a driveway near New York Avenue, a body shop lot, or the spot where it quit. Junk car removal explains the pickup.

Questions people ask

Does an expired tag make my DeLand car junk?
The code treats it as proof unless you show otherwise. Section 21-01: "The absence of a license plate for the current year or the absence of a current motor vehicle registration shall be prima facie evidence that a motor vehicle is abandoned, junked or discarded."
What happens after DeLand posts a notice on my car?
The notice says the vehicle "will be removed ten days following the date the notice is delivered." If the car is still there when that runs out, the city can remove it and charge the cost to the land and its owner.
Can I fight a DeLand junk-car notice?
Yes. The notice must tell you the finding "may be appealed to a hearing officer appointed by the city manager."
My registration lapsed while the car sat in a DeLand garage. Do I owe back tax?
Maybe not. Months a car was laid up in dead storage owe no license tax under Florida law, provided a notarized or certified affidavit says so. Otherwise, renewing late brings a delinquent fee somewhere between $5 and $250.
