Selling a stalled or junked car in East Point

On an East Point street, a car that cannot run is out of line from the first day. Section 12-2006 says any vehicle parked on a city street "must have a valid tag and insurance and be able to move under it's own power." The five-day clock in the same section matters less for a dead car than that last clause. We buy whole non-running and junk cars, and you sell the whole car as it sits. There is free pickup anywhere in the US, including the curb where it stalled.

Section 12-2006, line by line

  • Five days. "No vehicle shall be parked on a city street or public property for more than five (5) consecutive days in the same spot."
  • Then it is presumed abandoned. Past five days, the vehicle "shall be presumed to be abandoned and may be impounded by the police department."
  • No street storage. "It is also unlawful to store any truck, vehicle, chassis or body thereof in any public street." A shell with no engine is covered too.
  • Tag, insurance, power. The running requirement applies to any car on a city street, whether it was moved yesterday or not.

So nudging a dead car a few feet every few days fixes nothing. It still cannot move on its own.

On your own property

The East Point sections we read set no separate rule for a dead car in a driveway or yard, and East Point may still have other rules we did not see. East Point starts from the state rule. Georgia law calls an East Point car abandoned once it has sat untouched on private land 30 days or more.

Shops are covered as well. Leave a car with a repair shop, dealer or wrecker and fail to collect it for 30 days, and Georgia calls that abandoned too. If yours waits at a garage on a repair bill you have decided not to pay, keep an eye on that count.

When the contractor has your car

East Point's towing contractor handles unclaimed cars under Section 12-4006, which tells it to dispose of them "in accordance with the existing laws of the State of Georgia." On request, the city's communications department pulls owner registration records for the contractor at no cost. Vehicles sold by court order are listed by year, make and VIN and advertised at the Fulton County Courthouse and in the city's official newspaper "once a week for two (2) consecutive weeks before the sale date."

Georgia law runs its own clock first. Within 15 calendar days after a tow, the towing and storage firm owes every owner a letter, sent certified or handed over in person. That letter has to warn that, ten calendar days on, the firm can go to court over its lien and ask to foreclose. See towed or impounded.

Fulton County paperwork

One Fulton County Tax Commissioner office we checked is on Pryor Street: 141 Pryor Street SW, Atlanta. Its phone line is 404-613-6100. It is roughly 7 miles northeast of downtown East Point in a straight line. Fulton may have other offices too.

Georgia splits a sale into two jobs. Job one is the ownership transfer, signed on the title's back. The second East Point task is the registration. Cancel it at DRIVES e-Services, or mail in the paper Form MV-18J. Your plates stay yours; unbolt them before the car leaves. Hand the buyer the title, but photocopy it first, along with any bill of sale. Should a pending-suspension notice reach you after the sale, Georgia's revenue department tells sellers they may ignore it if the car was sold. More in after you sell.

Questions people ask

My car died on an East Point street. How long can it stay?
Not at all, strictly. Section 12-2006 says any car parked on a city street must have a valid tag and insurance and be able to move under its own power. Separately, a car left in the same spot for more than five consecutive days is presumed abandoned and can be impounded.
What rule covers a junk car parked in an East Point yard?
The East Point sections we read had no separate private-property rule, though the city may have others we did not see. So an East Point car left on private land with nobody tending it for 30 days or more is abandoned in Georgia's eyes.
What happens to a towed car nobody claims in East Point?
The city's towing contractor disposes of it under Georgia law. The tow firm owes owners a letter within 15 calendar days. Cars sold by court order are advertised at the Fulton County Courthouse and in the city's official newspaper once a week for two consecutive weeks.
