Junk and dead cars in Garden City

In Garden City, a car doesn't need a smashed fender to break the code. Section 38-58 calls a car a motor vehicle nuisance if it is "not currently registered or tagged," or "incapable of moving under its own power." It also covers a car in a "junked, wrecked or inoperable condition, regardless of registration or tag." If the car is missing even one part "necessary for the lawful operation of the vehicle upon a street or highway," the code presumes it is junked.

Where a dead car can stay

Section 38-58 spares two kinds of car. One is "enclosed in a garage or other building." The other belongs to a business that follows zoning and keeps vehicles "behind screening" dense enough to block the public's view and keep children out. A dead car out in the open on a house lot fits neither.

Snow routes run on inches, not days

Under Section 86-38, a snow emergency starts when snow is two inches deep "with more snow falling" or more is forecast, or when the city manager declares one. Cars must be off the emergency snow routes before the snow reaches two inches, or "within one hour" after a declaration. Downtown, the list includes Chestnut, Laurel and Pine streets between 8th and 7th.

The same section makes it unlawful to drive on a snow route in a condition where the vehicle "stalls and is unable to proceed." Once towed, a car can't be recovered before its owner pays for the tow and the storage.

Towing and impound costs

  • Paid in full first. Section 42-521 says impound fees "shall be paid in full before the vehicle is released." They include the towing.
  • Charged by the day. Section 42-251 sets the impound fee on "a per-day basis irrespective of the number of hours."
  • A stranger's car on your lot. Police can tow it when the owner, lessor or person in charge complains that it is there without consent. Section 86-36 then makes the complainant "responsible to the city for the costs."
  • A trailer at the curb. Under Section 38-86, you can't leave "any nonmotorized item of personal property not attached to a motor vehicle" on a street, alley or other public way "for any period of time."

The Kansas route for a parts-only car

Kansas has its own paper for a car that is only good for parts. K.S.A. 8-135c defines a nonrepairable vehicle as one so damaged, burned or flooded that it can't run safely and is worth only its parts or scrap, or one whose owner irreversibly designates it that way. Before selling such a car, the owner applies for a nonrepairable certificate, within 60 days of that determination. The fee matches an original title's, with $2 added for late filing.

For a Garden City car with a lost title, the certificate solves a second problem. For a Garden City car 10 or more model years old, the certificate alone can transfer it. That transfer is a one-time event; afterward the car gets dismantled or recycled and never carries a title again. Prefer a replacement title instead? Form TR-720B, $10, goes to Finney County's treasurer or straight to the Titles and Registrations Bureau by mail. See nonrepairable title.

For a regular Garden City sale, the title's back gets the price, date and mileage, then your printed name and signature. Kansas skips the notary. Keep the plate. Our Kansas page covers what's left.

Questions people ask

Is a car with expired tags a nuisance in Garden City?
Yes, under Code 38-58. Lapsed tags, no power to move on its own, or a junked, wrecked or inoperable condition can each make a car a motor vehicle nuisance, tag or no tag. Cars kept in a garage or other building are exempt.
When do I have to move a car off a Garden City snow route?
Before snow on the route is two inches deep, or within one hour of a declared snow emergency. A car left there can be ticketed and towed, then held until its owner pays for the tow and the storage.
My parts car has no title. Can it be sold in Kansas?
If it is at least 10 model years old, yes: a Kansas nonrepairable vehicle certificate can carry the transfer when no title is in hand. Such a car changes hands one time only and then has to be dismantled or recycled.
