Selling a junk or dead car in Ruston

Ruston's code asks a question most junk-car rules skip: is anyone actually fixing it? Under Section 21-32, a nuisance vehicle is one whose condition shows it "is not being used and maintained as an operating motor vehicle." It also asks whether the car or the area around it shows "active on-going efforts are underway to return the motor vehicle to operating condition." A project car with parts on the bench is one thing. A car that has not moved since last semester is another. For the second kind, we buy whole non-running and junk cars. Sell the whole car as it sits, with free pickup anywhere in the US.

The factors Ruston weighs

The code lists signs that point to a nuisance vehicle. One or more may be present:

  • "The motor vehicle is partially dismantled, partially disassembled or wrecked, or lacks major mechanical or body parts"
  • "The motor vehicle is not capable of movement under its own power in the manner in which it was originally intended, or is otherwise inoperable for use as a motor vehicle"
  • "The motor vehicle does not have a current license plate, registration, motor vehicle inspection sticker and/or it is evident that the motor vehicle is not currently operable in a legal manner"

The factors are weighed "in the aggregate." One flat tire on a car that is plainly being worked on is not the same as all three signs on a car nobody touches. A registered antique, 25 years or older, "significantly in its original condition," is defined on its own terms.

The sections we read do not set a notice period or a fine for a nuisance vehicle. The city may have its own procedure. State law lets parishes and cities write their own rules for junk vehicles and for towing and selling them.

Streets and downtown

Under Section 21-32, three days is the mark for an abandoned vehicle in the situations the code lists. On public streets the clock is shorter. Section 26-45 lets the chief of police tow and store any vehicle "which has been abandoned by remaining parked on any public street within the city for a period of 24 hours." Any car parked against an ordinance can be towed too.

Downtown streets on the city's list have a three-hour limit, 8 a.m. to 5 p.m., weekdays. Moving to a different block face starts a new period. An unpaid ticket climbs to fifty dollars after seven days. A car that dies on one of those blocks will draw attention fast.

State law adds its own step: an abandoned car found by police gets a windshield notice, and once 24 hours pass it can be removed.

Lincoln Parish sellers and the state title

There is no parish title office to visit; Lincoln Parish leaves titles to Louisiana's OMV. Its own offices, private tag agents and the mail all work. Start at the OMV.

Louisiana requires a notary for the seller's signature. The price belongs on the assignment; if it is missing, the buyer needs a separate notarized bill of sale. Keep the plate when the car goes. It can be canceled through the OMV website, mailed in or turned in at an office, and a $3.00 license transfer moves it to another car. Drop insurance only once the plate is canceled. A missing title is replaced with the Vehicle Application, DPSMV 1799, and the Duplicate Title Affidavit that goes with it, signed by the owner before a notary. Scrap buyers can accept an ownership affidavit in place of any title.

Questions people ask

I'm slowly fixing my car in the driveway. Is it a nuisance vehicle in Ruston?
Section 21-32 looks at whether the car and the area around it show "active on-going efforts" to get it running again soon. A car that has clearly been left alone reads differently from one with work in progress.
When can Ruston police tow a car left on the street?
Section 26-45 lets the chief of police tow a car left parked on any public street for 24 hours as abandoned.
What notice does Ruston give before acting on a nuisance vehicle?
The sections we read do not say, and the city may have its own procedure. Under state law, an abandoned car found by an officer gets a 24-hour windshield notice.
