Selling a junk or dead car in Rockville

Rockville puts a 15-day limit on fixing a car at home. Permitted repairs may go ahead "provided that they are completed within fifteen (15) days after their commencement" and the car is then legal to drive on a public street. Only four of those repair periods are allowed in front of one property in a year. When the fix is not coming, the car has to go somewhere. We buy whole non-running and junk cars, and you sell the whole car as it sits.

What Rockville's code says about a dead car

The parts of Rockville's code we read had no stand-alone junk-car section, so this is only part of the picture. Rockville could have more rules than these. What the code does say:

  • Where cars belong. "All motor vehicles shall be parked, kept, or stored in approved off-street parking areas or on an improved street." A car on the lawn or a dirt patch does not qualify.
  • The repair clock. The 15-day window above, capped at "not more than four (4) repair periods of fifteen (15) days or less" on or in front of any premises within one year.
  • Not trash. Section 20-9, the refuse storage rule for non-single-family buildings, lists "abandoned, unlicensed or inoperable vehicles" among things that "shall not be placed for regular collection."
  • Junk yards. The zoning definitions call any land used "for the abandonment of inoperable automobiles" a junk yard. That is a land use the zoning code governs, not something a home lot is set up for.

Maryland's 48-hour rule still applies

State law fills the gap. Transportation Article ยง 25-201 treats a car as abandoned when it "has remained on private property for more than 48 hours" against the wishes of whoever owns or controls that land. A car that can't run and sits alone on a public street past the same two-day mark qualifies too. Police can then take custody. A car nobody claims is eventually sold at public auction, free and clear of liens.

Snow emergency parking

When a winter storm is forecast for Montgomery County, Section 23-25 lets the City Manager announce snow emergency restrictions. Once declared, "it shall be unlawful to park or leave any vehicle on the street if the resident has a driveway." Without room in a driveway, parking moves to the even-numbered side. The city can impound a car parked against these rules until the owner posts collateral and pays the towing.

Title and plates

The Maryland MVA issues titles. You need one in your own name to sell; if it has gone missing, request a copy on VR-018 ($40.00) through myMVA, at an MVA counter or by mail, and our no-title guide covers the details. Montgomery County falls under VEIP emissions, but inspections are the buyer's job, not yours. Tags stay with the seller in Maryland; take yours off, give them back to the MVA, and keep insurance going until its receipt arrives.

Questions people ask

In Rockville, how long may I keep fixing a broken car at home?
The code allows permitted repairs if they are finished within 15 days of starting and the car is then legal to drive on a public street. No more than four such 15-day repair periods may happen on or in front of one property in a year.
Does Rockville have a junk-car ordinance?
We did not find a stand-alone junk-car section. The code requires all motor vehicles to be kept in approved off-street parking or on an improved street, and Maryland's 48-hour abandoned-vehicle law applies. The city may have other rules, so check with Rockville before relying on this.
Can I leave a dead car out for city trash pickup?
Not at an apartment or other non-single-family building. Section 20-9, which covers refuse storage at those buildings, lists abandoned, unlicensed or inoperable vehicles among the items that may not be placed for regular collection. The parts of the code we checked do not say how this applies to single-family homes.
