Selling a dead or junk car in Franklin

Lots of Franklin's dead cars aren't parked at home. They're stuck at a repair shop behind a bill that's larger than the car's value. Massachusetts law spells out what a garage may do with a car nobody claims, and the last step is a sale. If you'd like to sell before it gets that far, we buy whole non-running and junk cars, and you sell the whole car as it sits.

When a Franklin car sits at a garage

Chapter 255, section 39A sets the order. To start, the shop mails the registered owner a letter by registered mail, return receipt, stating its storage rates. If 60 days pass after the car arrived and no one has claimed it, the shop may send notice. A Franklin garage can sell in public or private 21 days later. First, a local paper prints its notice three weeks straight, and the police chief gets word 5 days ahead.

Whatever the car brings, the Franklin shop first takes its charges out of it. If a Franklin garage sale brings in more than its bill, the extra goes to the registered owner, and if that fails, to the district court clerk. If selling it yourself is the plan, talk to the shop before those letters begin. Our car at a repair shop guide covers settling the bill and getting a release.

Franklin junk-car rules: state law

We found no Franklin bylaw text online. So this section uses state law, and Franklin's town offices are worth a call before you lean on it, since a local rule on unregistered or broken-down cars could add limits.

Statewide, c. 90 s. 22C deals with cars that seem abandoned. If a car sits over 72 hours on a way or lot without permission and is worth less than the tow and scrap cost, a Franklin officer can haul it off. The junkyard statute, chapter 140B, is aimed at businesses. A Franklin homeowner's idle car is not its target.

If an insurer totaled it

A totaled car's title may carry a brand. Massachusetts sets no percentage cutoff. In Franklin, a car that stays broken after its owner or insurer decides fixing it makes no money sense is called a total loss salvage vehicle. Two primary brands exist: repairable (REPR) and parts-only (PART). A second brand records what happened, such as fire, theft or flood.

Brands never come off; no clean title is possible afterward. A PART car can never return to Massachusetts roads, and a REPR car stays unregistered until it clears the RMV's salvage inspection. Age helps here. A Franklin passenger car that was already 10 years old when the loss happened doesn't get a salvage brand. More in salvage title.

Signing over and the plates

Selling privately in Franklin? The Registry of Motor Vehicles (RMV) steps never send you to a notary. Put down the mileage; each party signs, prints and dates. When a Franklin title lacks a price line, list the price on a bill of sale. The plates stay yours. Cancel the Franklin registration online, then destroy or recycle the plates, or move them to your next vehicle inside 7 calendar days.

Questions people ask

Can a Franklin garage sell a car nobody picks up?
Yes, eventually. Under Chapter 255, section 39A, a garage may send notice when nobody has claimed a car for 60 days, and sell it 21 days on, after three weeks of ads in a paper and 5 days' notice to the police chief. Money beyond its bill is paid to the registered owner.
Is there a Franklin bylaw on junk cars?
Franklin's bylaws weren't online for us, so this page relies on state law. Franklin's town offices can say whether a local rule applies.
My Franklin car came back from the insurer branded PART. Can it ever be registered?
Never, in Massachusetts. Parts-only is the end of the road for registration, and every salvage brand stays on the title for good.
Does every totaled car in Franklin get a salvage title?
No. If a Franklin passenger car had reached 10 years old by the day of the loss, the salvage-title steps don't apply.
