Selling a junk or unregistered car in Concord

In Concord, letting a car's registration lapse is enough to break the city code, even if the car never leaves your driveway. Section 27-1-5 says "no unregistered or uninspected motor vehicle shall be parked, kept or stored on any premises." The same sentence covers any vehicle "in a state of major disassembly, disrepair or in the process of being stripped or dismantled."

What section 27-1-5 covers

The rule sits in Concord's Housing Maintenance and Occupancy Code, the city's amendments to the 2018 International Property Maintenance Code. It has one stated exception: "article 28-7-16 Parking and Storage of Unregistered Vehicles, of the Zoning Ordinance." If you think your car fits that exception, ask the city before relying on it.

The rule names two separate problems:

  • the car is unregistered or uninspected, or
  • the car is in major disassembly or disrepair, or being stripped.

Annual state inspections are on hold until further notice, so stations can't give out state stickers. How the city reads "uninspected" while that lasts is a question for the city.

What happens after a notice

The code gives the owner a set time in the notice and order. If the violation "has not been abated within the time specified," the Code Administrator may go to court for "injunction, abatement, or other appropriate action" under RSA 676:15. Or the administrator may issue a citation under RSA 676:17-b, with penalties from Section 28-9-8d of the Zoning Ordinance, or do both. Ignoring the order is its own offense: a person who "refuses or neglects to comply" is "guilty of a separate offense for failure to comply with the order." Our notice to remove a car guide covers what to do with the letter.

Two street clocks

Pushing a dead car out to the street just puts it under a different rule:

  • 48 hours. Section 18-1-11 bars leaving a vehicle "on a public right-of-way for a period of time exceeding forty-eight (48) consecutive hours unless otherwise specifically authorized by the Chief of Police or his designee."
  • 24 hours. Under 17-1-16, a vehicle "parked in violation of any provisions of this title for a period of time greater than twenty-four (24) hours" is an abandoned vehicle for the traffic title.

Title and plates in New Hampshire

Concord is home to the state capitol, but the title step happens between you and the buyer. A car from 2000 or later has a New Hampshire title you sign over when you sell. On the back, a Concord seller writes in the mileage plus the buyer's name and address. You both sign, and the buyer takes it. For a model year before 2000, there is no title. Hand over a bill of sale (TDMV 22A) along with a TDMV 19A or a copy of an earlier registration or title.

You keep the plates, and selling ends the registration. Hold on to that expired registration, since the town or city clerk gives transfer credit for it.

In a straight line, Manchester sits roughly 18.1 miles off, Bedford roughly 20.6 and Londonderry roughly 25.8. See New Hampshire for statewide rules.

Questions people ask

Is an unregistered car allowed in my driveway in Concord?
Under Concord's Housing Maintenance and Occupancy Code (27-1-5), you can't park, keep or store an unregistered or uninspected motor vehicle on any premises, apart from what article 28-7-16 of the Zoning Ordinance allows. The same rule bars a vehicle in major disassembly or disrepair.
What if a notice comes and I ignore it?
If the violation is not abated in the time given, the Code Administrator may seek an injunction or abatement under RSA 676:15, or issue a citation under RSA 676:17-b with penalties set in Section 28-9-8d of the Zoning Ordinance. Refusing to comply with the order is a separate offense.
How long may a car stay on a Concord street?
Concord Section 18-1-11 caps parking on a public right-of-way at 48 consecutive hours unless the Chief of Police or a designee approves more. Section 17-1-16 calls a car abandoned after over 24 hours parked against the traffic title.
The state paused inspections. What about the word uninspected in the city code?
New Hampshire has paused its inspection program until further notice, and stations can't hand out stickers. How the city applies the word uninspected while that lasts is a question for the city.
