Getting rid of a dead car in Deer Park

In Deer Park, a dead car on the front lawn breaks a city rule long before it counts as junk. Section 66-79 bars any vehicle "anywhere on the front yard residential lot, except in the garage or driveway, for more than two consecutive hours." The fine runs $50 to $250. If that car is finished, we buy whole non-running and junk cars, and the truck comes to you with free pickup anywhere in the US.

Deer Park's two-part junk test

Section 38-242 needs two things at once. The car first "displays an expired license plate or invalid motor vehicle inspection certificate", or shows neither. On top of that, it must be smashed, half gutted or junked outright, or else frozen in place past a clock: a three-day stretch (72 hours) when parked publicly, or a full month (30 days) when parked on somebody's lot.

The city's Junked Vehicles page shortens this to a car that won't run and has stayed put for 72 hours. The code text is the longer rule above.

On a street or other public land, a junked car is a public nuisance outright. On your own lot, it becomes one once it is in plain sight of a sidewalk, street or similar public vantage point, summer or winter. Park it behind closed garage doors, invisible to all, and the rule lets it be. Fences, trees and shrubs count as cover only for dealers, junkyards and collectors keeping an antique or special interest vehicle.

The letter, and the ten days after it

Section 38-246 sends a certified letter to three parties: whoever the car is registered to, any lienholder, and finally whoever holds or rents that patch of ground. It says the car "must be removed and abated within ten days after the date on which the notice was mailed". To fight it, ask the city secretary for a hearing before day ten.

Court cannot convene on it until day 11 after service. Deer Park's judge presumes a dead car. Showing otherwise is your job. If the city hauls it off, Section 38-249 says it "cannot be reconstructed or made operable", and within five days the officer asks the state to cancel its title. The general penalty reaches $500, or $2,000 for certain health, safety and zoning rules, with every day a fresh offense.

Abandoned cars and the police lot

Deer Park counts a car as abandoned in two cases. One is an inoperable car older than five years, unattended on public land past 48 hours. The other is any car parked illegally on public land, or on private land without permission, past 48 hours. Police have ten days to mail notice after they take one. Through day 20 following that letter, an owner or lienholder may reclaim it by covering tow, preservation and storage costs. Left unclaimed, it can be auctioned, and money left over after the city's costs is held 90 days. The police non-emergency line is 281-479-1511.

Title and plates through Harris County

In Texas the county runs title work, and Deer Park's county is Harris. Its tax assessor-collector sits at 1001 Preston in Houston, roughly 16 miles west as the crow flies. Its phone number is (713) 274-8000. The buyer files the new title there, so you can skip the drive.

Your side of the deal is short. Date the title, note the odometer, sign. Sign Form 130-U as well, with the price filled in. Nobody has to notarize anything. Then let TxDMV know it changed hands. That notice (paper Form VTR-346, or the web version) is due inside 30 days, and it keeps the new owner's tolls and parking tickets away from you. The plates are yours to pull. Keep them, bolt them onto another vehicle of that class, or deface them; the registration sticker stays behind. A missing title is covered in selling with no title.

Getting an offer

Call (877) 421-6008 or use the form. Give us the model year and name, roughly how worn the odometer is, whether it turns over, and the title's condition. You sell the whole car as it sits, and the truck can collect it from your driveway, a repair shop or a workplace lot. Pasadena is 3.3 miles from Deer Park, and La Porte is 4.4 miles away. Statewide rules are on the Texas page.

Questions people ask

Is the front lawn a legal spot for a dead car in Deer Park?
Only for two hours. Section 66-79 keeps every vehicle off a home's front yard, apart from the garage and the driveway, past two consecutive hours. Breaking it is a misdemeanor, fined $50 to $250.
Does a car with current tags count as junked in Deer Park?
Under Section 38-242, no. A car must first be showing a stale or absent plate or inspection sticker. Only then does the second half, wrecked, dismantled, discarded or long unable to run, come into play.
How long do I have after the city's letter?
Ten days. The count starts when the city mails the certified letter, not when it lands in your box. A court hearing is yours if you file for one with the city secretary inside that window.
Does a Deer Park sale need a notary stamp?
No. The TxDMV title manual asks for no notary on any of the three seller papers: title, bill of sale, odometer statement.
