Selling a junk or dead car in La Porte

In La Porte, a fence along the street may not be enough to hide a dead car. Section 34-168 says a junked vehicle is a nuisance if it can be seen "at any time of the year" from public places and rights-of-way, "or private property." The view from a neighbor's yard counts as much as the view from the road. If a car out back has quit for good, we buy whole non-running and junk cars. You sell the whole car as it sits, and pickup is free anywhere in the US.

La Porte's two-part test

Section 34-166 joins two conditions with "and." First, the car shows an expired or missing license plate or inspection certificate. Second, it is wrecked, dismantled, discarded, or inoperable longer than La Porte allows: 72 consecutive hours for public property and 30 consecutive days for private. The city FAQ gives a shorter version without those limits.

Keeping a visible junked vehicle is a misdemeanor, and La Porte needs no proof of intent. Article V names no fine. When no penalty is named, the general penalty in Section 1-14 applies: a fine as high as $500, with a $2,000 ceiling for public health and sanitation, zoning, or fire safety violations. Every day counts separately.

The exception for an ordinary owner is a car "completely enclosed within a building in a lawful manner" where no one on the street or another lot can see it. Vehicle dealers, junkyards and collectors have their own screened-storage rule. Section 106-838 also bars using required off-street parking spaces to store inoperable vehicles.

Notice from the planning director

La Porte's planning director mails certified notice, at least ten days ahead, to each lienholder, the registered owner, and the person who owns or lives on the property. Day ten is the cutoff for both removal and any hearing request. If asked, the hearing goes before the council, the municipal court judge or another designated official. It is held no earlier than day 11 after service, and the presumption that the car is inoperable stands unless the owner rebuts it.

Moving the car does not end it; relocation "does not constitute an abatement" while the car stays a nuisance where it ends up. Signing written permission for La Porte to remove it, within ten days, also satisfies the notice. If La Porte hauls the car, it is hauled for scrap or salvage to a scrapyard, a demolisher or a site La Porte operates. A car sent to a demolisher transfers on "Form #MVD 71-5." Within five days the state is told and cancels the title. Afterward it "shall not be reconstructed or made operable by any person."

Reports go to Inspection Services, 281-470-5073, or La Porte Support online or in the app. Code Enforcement sits at 604 W Fairmont Parkway, 281-470-5074. Volunteer Neighborhood Liaisons also report visible junk cars from their own vehicles and never step onto private property.

Streets and storage lots

Section 70-178 caps any vehicle knowingly left standing on public streets, alleys or other public ground at 24 continuous hours. Officers may also tow a car that looks abandoned, or one too disabled to drive when its driver cannot arrange removal. After a non-consent tow, daily storage starts only after the first 12 hours, unless pickup falls outside weekday business hours of 8 a.m. to 5 p.m. Police non-emergency: 281-471-2141. Next steps are in towed or impounded.

Harris County title office and Texas rules

La Porte is in Harris County. About 20 miles west of La Porte as the crow flies, Harris County's tax office stands at 1001 Preston downtown; call (713) 274-8000. That is where the buyer applies for a title, and the state record keeps your name until the new title issues.

That gap is why the transfer notice matters: get your Vehicle Transfer Notification to TxDMV before 30 days have passed since the sale. Give the buyer the title, signed, with the date and mileage filled in, plus your signed Form 130-U listing what the buyer paid. No notary is required. You may take off the plates and registration sticker. Plates can go on your next car at no charge from the county office; the sticker cannot. Form VTR-34 replaces a lost title, signed by every recorded owner. See selling with no title.

Questions people ask

My backyard fence blocks the street view. Is the dead car hidden enough in La Porte?
Maybe not. Section 34-168 counts views from public places, rights-of-way and private property alike, so a neighbor's view also counts. Only a car shut inside a building, out of everyone's sight, is exempt.
What is La Porte's time limit for a car on the street?
Section 70-178 makes it unlawful to knowingly leave a vehicle standing on La Porte's public streets, alleys or other public places beyond 24 continuous hours. Officers can also have a car towed if they believe it is abandoned, or if it is too disabled to drive and nobody in charge of it can arrange removal.
Can I let La Porte take the car instead of fighting the notice?
Yes. Section 34-173 treats written consent to removal, given within ten days of the notice, as compliance. After removal the car can never be rebuilt.
When does tow storage start costing money in La Porte?
For a non-consent tow, daily storage may be charged only after the first 12 hours, unless the car is collected outside 8 a.m. to 5 p.m. Monday through Friday. Appendix A of the code lists the maximum amounts.
