Selling a junk or dead car in Pharr

A Pharr car does not have to be broken to break the rules. Under the city's zoning code, a car whose plate or inspection sticker lapsed over three months ago can only be kept on a residential lot inside a completely enclosed building with paved parking. A dead car with lapsed tags in the driveway is a violation twice over. If that is your car, we buy whole non-running and junk cars. You sell the whole car as it sits, and pickup is free anywhere in the US.

The three-month rule on home lots

Zoning section 1.54 reads: "Automotive vehicles or trailers [bearing] license plates or state motor vehicle inspection stickers that are more than three months out of date shall only be parked or stored on any residentially zoned property in a completely enclosed building and with paved parking."

The same section keeps every motor vehicle out of front yards in Pharr's residential districts unless the parking is paved and approved by building permit.

Pharr's junked-vehicle test

Chapter 126, section 126-296, calls a self-propelled vehicle junked in Pharr if any one of these holds:

  • it is inoperable and lacks an unexpired plate or valid inspection certificate
  • it is wrecked, dismantled or discarded
  • it has sat dead for over 45 days straight

Section 126-297 labels such a car a public nuisance whenever it shows from a Pharr street, sidewalk or other public place. Maintaining one is a Pharr misdemeanor; a $200 fine is the ceiling, and the court orders the car removed. Pharr says its procedures conform to Texas Transportation Code chapter 683, subchapter E.

Pharr's procedures stop at the door of a lawful, fully closed building that hides the car from the street and neighbors.

From letter to scrap yard

  1. Notice. Pharr mails it certified at least ten days ahead, addressed to the car's owner of record, its lien holders and the Pharr property owner or occupant, telling them to have the car gone by day ten.
  2. Hearing. Request one and the chief of police or a designee hears it, though never sooner than day 11. Pharr presumes the car is dead unless you show it runs.
  3. Removal. Once removed, a car may never be rebuilt or put back in working order. Section 126-303 sends it "to a scrap yard, a motor vehicle demolisher, or a suitable site operated by the City of Pharr."

Code Compliance lists junked or inoperable vehicles on private property among its common violations. Questions and case updates go to (956) 402-2633; report a possible violation through Pharr 3-1-1, where callers can stay anonymous. For a report that likely does not need an emergency response, the public safety line is (956) 402-4911.

Streets and towing

No vehicle may stay on a Pharr street, alley, avenue or public way for over 24 hours without moving. A Pharr officer may also tow a parked car from the street on reasonable grounds to believe its owner walked away from it.

If Pharr impounds it, section 126-240 says the owner pays the cost of impounding or moving it, which "shall not exceed the maximum rate allowable under the current wrecker ordinance." That ordinance caps storage at a state-licensed facility at $20 a day. If you reach the scene before the tow leaves, you pay the drop fee, with no towing or storage fees.

Registration, title and the Hidalgo County office

Texas lets an owner renew a lapsed registration online for a year after it runs out, as long as Pharr police or anyone else have not ticketed it for the lapse. Driving on it past the fifth working day after it expires is an offense. For a car you plan to sell, renewing just to satisfy section 1.54 rarely makes sense.

Pharr title work happens at the Hidalgo County tax assessor-collector, 2804 S. Business Hwy 281 in Edinburg, (956) 318-2157. As the crow flies, that is roughly 8 miles north of central Pharr. Your buyer applies for the title there. You date the title, add the mileage and sign, with no notary, then send TxDMV a Vehicle Transfer Notification before 30 days pass, so Pharr tolls and tickets run by the new owner stay off your record. The plates can leave with you.

Online or at (877) 421-6008, describe the Pharr car: year, make, model, miles, whether it turns over, and the title situation. Our truck goes to it, in a driveway, a garage or a side yard. San Juan is 3.2 miles away; see Texas for the state rules.

Questions people ask

My registration expired four months ago. Can the car stay in my Pharr driveway?
Not out in the open. Pharr's zoning code allows a vehicle with plates or inspection stickers more than three months out of date on residentially zoned property only inside a completely enclosed building with paved parking.
Who runs the junked-vehicle hearing in Pharr?
The chief of police or a designee. Pharr cannot hold it before day 11, and the car is presumed inoperable there unless the owner proves it runs.
What does storage cost if Pharr tows my car?
The owner pays the cost of impounding or moving it, capped at the maximum in the city wrecker ordinance. That ordinance caps storage at a state-licensed facility at $20 a day.
