Selling a Jacksonville car that is dead or junk

In Jacksonville, a smashed back glass is enough. Section 8.03.017 of the city code says a car "shall be deemed inoperable" when "the front or rear windshield is broken, removed, or missing," or when a side window is gone. The same section catches something most owners never think about: a car whose interior is "used as storage container(s)." Section 8.01.082 then bars keeping an inoperable or unlicensed car "on any premises." If yours fits that picture, we buy whole non-running and junk cars, and you can sell the whole car as it sits.

How long Jacksonville gives you

The clock depends on where the car is parked. Section 8.03.014 sets two notice periods before a Code Enforcement Officer can have it hauled off:

  • 72 hours when the car sits near a public street. The Notice of Violation must stay on the car "for a period of no less than 72 hours."
  • 30 days when it sits away from the street, such as behind the house.

Public land is stricter still. Jacksonville's Section 8.03.013 bars parking a vehicle on a public right of way or other public land "(or within three feet thereof)." Once a car is tagged, its owner gets "Twenty-four (24) hours" to move it. An officer who sees a safety risk can order it moved at once.

Section 8.03.016 allows a car that does not run to stay only "within enclosed spaces upon property that is properly zoned and permitted for that purpose." You can do body work and major overhauls, but only in a building made and approved for that.

Driveway and front-yard limits

Section 8.03.018 bans parking on the front yard of a one- or two-family home. A standard passenger car may sit on the driveway, or beside it on one side only, if it does not block the sidewalk or anyone's line of sight. Parking on the street so that it gets in the way of mail, garbage or yard-waste pickup is also unlawful. And Section 8.03.013 says "no person shall regularly park" in the right of way day after day.

When the police tow it

For a removal, the Jacksonville Police Department pulls the latest registration, checks whether the car is stolen, and calls a wrecker under department policy. The towing company must follow Arkansas Code 27-50-1101 and send the owner written notice. Arkansas gives the lot a window for that certified letter: not before the second business day after the car comes in, and not after the eighth. A 45-day reclaim period then runs from the letter; once it lapses, a public sale is allowed. Our towed or impounded guide walks through the choices.

Title and plates from Jacksonville

Pulaski County does not issue titles. The Arkansas Department of Finance and Administration handles them at its State Revenue Offices, and MyDMV lets you apply for a title or move a plate online.

To sell, you sign over the title and hand it to the buyer. Next, you and the buyer complete DFA Form 10-313, which is the bill of sale and odometer statement. It needs the buyer, the VIN, the date of sale, a description, the miles, the full price and both your signatures. DFA's seller steps do not call for a notary. Take your plates off and keep them. Putting them on your next car costs $1.00. The Notice of Transfer of Ownership is optional and free. A lost title costs $10.00 to replace and takes three weeks or longer. Read selling with no title.

Questions people ask

Does a broken window make my car inoperable in Jacksonville?
Yes. Section 8.03.017 treats a car as inoperable when the front or rear windshield, or a side window, is broken, removed or missing. A car whose interior is being used as a storage container counts too. Once a car is inoperable, Section 8.01.082 bars keeping it on any premises outside an approved enclosed space.
How long before Jacksonville can tow a dead car from my yard?
It depends where the car sits. If the car is by a public street, a Code Enforcement Officer must leave a Notice of Violation on it for 72 hours or more before ordering it towed. Away from the street, the notice must stay on for at least 30 days.
Does an Arkansas car sale have to be notarized?
The DFA's seller steps list no notary. Jacksonville sellers sign over the title first. Then both sides of the Jacksonville sale sign Form 10-313, which is the bill of sale and odometer statement. It has only signature lines.
Do my plates go with the car?
No. Jacksonville sellers keep the plates, as everyone in Arkansas does, and DFA charges $1.00 to put them on a replacement vehicle.
