Selling a dead or junk car in Eastvale

Filing Planned Non-Operation with DMV stops the registration fees on a parked car. In Eastvale it also flags the car. Section 8.18.020 lists "vehicles that have a planned non-operational status with the California Department of Motor Vehicles" among the signs of an inoperable vehicle, next to lapsed registration and the lack of "a working engine, transmission, wheels, inflated tires, doors, windshield." Even flat tires can be a factor.

Where an inoperable car may sit

Under the zoning code, Section 120.05.060, any vehicle "which is inoperable and/or without current registration shall be stored entirely within an enclosed structure" and may not be parked or stored in any yard in a residential zone. Section 8.18.030 says the same from the nuisance side: such a car is a nuisance "unless kept, placed, parked, or stored inside of a completely enclosed, lawfully constructed building or structure." Parking it on the driveway fails that test, and so does tucking it into a gated side yard.

So the PNO that saves you fees can still leave the car needing a garage.

Three days on the street, and the 500 feet

Section 10.20.020 bars leaving a vehicle on a city highway "for a period in excess of three days." Shuffling it does not reset the clock: once tagged, the car may not be parked "within a radius of 500 feet from the original location" to get around the limit.

Hearings and impound costs

Section 10.04.080 lets the landowner or the car's owner request a public hearing, and the request "shall be made in writing to the code enforcement department within ten days after the mailing of the notice of intention." A landowner's sworn statement denying responsibility counts as one. Without a timely request, code enforcement may remove the car.

When the city impounds a vehicle under Chapter 10.48, an administrative charge is added on top of towing and storage. All of it must be paid before release and becomes "a lien on the vehicle," and unpaid costs can lead to a lien sale under the Vehicle Code and Civil Code.

Title steps for an Eastvale seller

Titles are all handled by the state DMV. Riverside County has no part in them. Sign the Certificate of Title as seller. The new owner then has 10 days to report the change and owes DMV's $15 charge. In Eastvale, your part is filing REG 138 within 5 days, and from then on tickets dated after the sale stop coming to you. A car left unregistered with no PNO on file racks up back fees and penalties for every gap year. Regular plates usually remain on the car. For a car still on a loan, see still owe on the loan. A slipping or dead gearbox? Read bad transmission.

Norco is 3.1 miles off, measured straight, Chino 4.9 and Ontario 5.3. Corona and Jurupa Valley are each 7.1. State rules: California.

Questions people ask

My car is on Planned Non-Operation. Is that a problem in Eastvale?
It can be. Under Section 8.18.020, planned non-operational status is one mark of an inoperable car. Section 120.05.060 says a car like that must stay fully inside an enclosed structure and never sit in a residential yard.
Can I dodge the 72-hour limit by moving the car a few spaces?
Not after it is tagged. Section 10.20.020 forbids re-parking within a 500-foot radius of where it stood to get around the limit.
Where does an Eastvale hearing request go?
To the code enforcement department, in writing, inside ten days from when the notice of intention was mailed (Section 10.04.080).
