Selling a dead or junk car in Holly Springs, GA

Holly Springs is one of the few cities whose code names a car cover. Section 34-106 allows a junked or inoperable car on a home lot only when it is "garaged and entirely stored inside a structure, or completely covered by a fitted vehicle cover and stored from sight of public streets and rights-of-way." A loose tarp on a car anyone can see falls short. If you would rather not deal with covers at all, we buy whole non-running and junk cars. You sell the whole car as it sits, and pickup is free anywhere in the US.

A flat tire is enough

The city's definitions in Section 34-102 set a low bar. A car is inoperable if it "is unable to move under its own power, has one or more flat tires," or lacks the minimum equipment Georgia law requires. A car that runs fine but has sat on a flat since spring qualifies.

The same section defines a dismantled vehicle as one missing factory parts that were never replaced. Section 34-106 is strict about those: "No dismantled vehicles or dismantled vehicle parts shall be stored anywhere on residentially zoned private property." No cover or fence changes that.

The mayor and council put their reasons in Section 34-101: such vehicles "present a danger and nuisance to the public" and hurt "the economic vitality of the community."

Streets and parking decks

Under Section 34-105, police can remove a junked car from a public street "without notice or prior warning," following the state's abandoned-vehicle procedures. A car that is not junked but sits on the street gets marked, and if it is still there "in excess of five consecutive days," it can go too.

The city's parking decks have a shorter fuse. Section 74-121 lists "Inoperable vehicles remaining longer than twenty-four (24) hours after entry" among the things not allowed in a deck or covered parking structure.

If the car is at a shop

Section 34-108 covers commercially zoned property. A repair shop has to keep cars awaiting repair inside a building. One exception lets a car that runs but lacks a current plate and decals stay outside while it is being fixed to pass Georgia emissions testing. Once the tag is more than six months expired, it goes indoors or off the lot.

Cherokee County is in the emissions program. The test is tied to 2026 registration of 2002-2023 gasoline cars and light trucks.

The Cherokee County tag office we checked

There is an office at 2780 Marietta Hwy in Canton, phone (678) 493-6400, roughly 3 miles north of central Holly Springs in a straight line. Cherokee may have more offices, but we only checked this one.

Georgia title rules from Holly Springs

Sign the title over on its back. You and any co-owner each print a name and sign as seller. Write the odometer in whole miles. Keep a copy before the title goes. After that, the registration has to be cancelled: online via DRIVES e-Services, or in Canton with an MV-18J form. Take the plates off and keep them, since in Georgia they never pass to the buyer.

No title for an older car? Once a vehicle reaches 12 model years, state rules let salvage buyers and scrap recyclers accept an owner's affidavit in its place. Salvage dealers then report each purchase to the state inside 48 hours from the close of business, and they cancel titles using Auto Data Direct. Our no-title page has more.

Questions people ask

Can a car cover keep me in line with the Holly Springs code?
On a residential lot, yes, if it is done the way Section 34-106 describes: the car must be completely covered by a fitted vehicle cover and stored out of sight of public streets and rights-of-way. A garage or other structure also works.
My car runs but has a flat. Is it inoperable in Holly Springs?
Yes. Section 34-102 lists a single flat tire as one of three signs of an inoperable car. The other two: it cannot move on its own power, or it is missing equipment state law requires.
Can I keep the engine I pulled out in the backyard?
No. Section 34-106 bars dismantled vehicles and dismantled vehicle parts anywhere on residentially zoned private property, covered or not.
