Woodstock: selling a car that will not run

Woodstock never asks whether a car is wrecked. Section 30-8 settles it in one line: "A junked motor vehicle is one that is inoperable." A sedan that quit in the driveway last spring sits in the same legal box as a rusted shell. We buy whole non-running and junk cars, so you can sell the whole car as it sits, dead battery and all. We offer free pickup anywhere in the US, and that covers every street in Woodstock.

The 30-day notice under Section 30-8

The rule is aimed at whoever owns or lives on the property. Nobody but a licensed junk dealer may let junk pile up, and the list names "discarded, dismantled, wrecked, scrapped, ruined or junked motor vehicles, or parts thereof."

Enforcement starts with a letter. The code enforcement officer must tell the owner or occupant in writing that the material "must be removed within 30 days from the date of such notice." Count from the date on the notice, not the day you open it.

If the car is still there, the case moves to Municipal Court. After a conviction, the Chief of Police may have the city or a hired firm haul it off. The municipal judge can also set a fine under Section 1-7 "for each day the junk remains in violation."

If your car was towed

Section 42-80 limits what a wrecker can charge after a tow the owner did not ask for. The City Council sets the allowed fees once a year, and a tow firm may collect "only approved charges." Three lines in that section are worth knowing:

  • Get back before the car is hooked or loaded, show the key and drive off, and "No fee of any kind shall be charged."
  • If it is hooked but still on the property, only a capped operator fee is allowed.
  • No storage can be billed for days the impound lot is closed or otherwise unavailable to you.

Cars taken into police custody follow Section 22-22. Impounded property, and property whose owner is unknown, "shall be held for a period of 90 days unless claimed by the owner." Our towed or impounded guide covers what comes next.

One more spot to watch: Section 42-62.1 lists "Inoperable vehicles remaining longer than 24 hours after entry into a parking deck" among the things a parking deck does not allow. The section also says "except as otherwise permitted by law," so the 24-hour clock is the line to watch.

A Cherokee County tag office in Canton

Georgia's Department of Revenue owns the title system; each county runs the counter. One Cherokee office we checked: 2780 Marietta Hwy, Canton. Call (678) 493-6400. Measured as the crow flies, Canton's office is roughly 7 miles north of central Woodstock, and Cherokee may run other locations too.

Emissions are part of owning a car here. Cherokee belongs to the group of 13 metro counties where gas cars and light trucks get tested before registration; for 2026 that means model years 2002 to 2023.

Signing the title over

Turn the original Woodstock title over for the seller section. Print and sign under Seller, and if there are two owners, both of you do it. The odometer goes in as whole miles. Mistakes are costly here: the Department of Revenue warns that erasures or alterations can void a title.

Then finish the job. In Georgia plates belong to the seller, so unscrew them and keep them. Next, cancel the registration: DRIVES e-Services takes it online, or hand in Form MV-18J at a tag office. Only after that, drop the insurance, which keeps you clear of penalties. Title missing? Form MV-1 gets a replacement for $8.00. Georgia has no title at all for a 1985 or older car. It sells with a bill of sale. See selling with no title.

Questions people ask

What does a Woodstock junk notice give me?
Section 30-8 gives 30 days from the date of the written notice. If the junk is still there, the case goes to Municipal Court. After a conviction the Chief of Police can arrange removal, and the judge may fine you for each day it stays.
Can a tow company charge whatever it wants in Woodstock?
No. Section 42-80 limits wreckers to fees the City Council approves each year. Come back before the car is hooked or loaded, while it is still on the premises, produce the ignition key and remove it right away, and there is no fee at all. If it is already hooked but has not left, the same key-and-remove steps limit the charge to a capped operator fee. Days the lot is closed carry no storage charge.
Who keeps the plates after a Woodstock sale?
You do. Georgia plates stay with the seller. Hold on to them. To cancel the tag, a Woodstock seller uses DRIVES e-Services online or brings Form MV-18J to a Cherokee County tag office.
How long does Woodstock police hold an impounded car?
Section 22-22 says impounded property, and property whose owner is unknown, is held for 90 days unless the owner claims it.
