Selling a junk or dead car in Twin Falls

When Twin Falls police impound a car, the bill for towing and storage becomes a lien in the city's favor against that car. Section 6-5-4 says those costs "shall constitute a lien in favor of the city and against such vehicle," and anyone claiming the car "shall pay to the city all costs including storage" before getting it back. A dead car that ends up impounded can owe more than it is worth before you even see it.

A day on the street

Twin Falls keeps a short leash on dead cars at the curb. Section 9-6-8(C) reads: "No unused, inoperative, abandoned vehicle or recreational vehicle shall be parked for more than twenty-four (24) hours on any street." The same section restricts trucks and trailers on streets and alleys, with an exception for trailers parked within 100 feet of a permitted construction job.

So a car that died on the way home and is sitting in front of the house is on a one-day clock. If it cannot be moved under its own power, getting it off the street is the first job.

When it is impounded

Three city sections work together once a car is taken in.

  • The lien. Under 6-5-4, the police department assesses the costs of taking and keeping the car, towing and storage included, against the car itself.
  • Paying to claim it. Whoever claims the car pays all of those costs, storage included, before taking it.
  • Appraisal. The code also has a section, 9-12-13, on the appraisal of impounded vehicles and who may appraise them.

State law adds its own steps. Twin Falls tow companies report a tow to ITD inside 1 business day. If nobody claims the Twin Falls car, a second first-class letter goes out after 5 business days (some tracks use 10). The final letter comes at 15. Once 30 days pass from its first notice, the Twin Falls towing company may request a title or junk certificate. See towed or impounded.

Abandoned on your property

Section 9-12-8 lets "any person having possession or control of real property who finds an abandoned vehicle upon that property" have it removed by a peace officer. Idaho law gives a second path for land that is not commercial and not posted: sign a release form with a tow company and it removes the car. See car abandoned on your property.

A dead car parked on your own land

The Twin Falls sections we read deal with streets, abandoned vehicles and impounds. None of them limits how long you may keep your own inoperable car on your own driveway or yard. That does not mean no such rule exists, so ask the city before counting on it.

Title work in Twin Falls County

For a private sale, title papers are handled by the Twin Falls County assessor's motor vehicle office. Expect $14 for the title with the county's admin fee added. A buyer who misses the 30-day filing window owes a $20.00 penalty.

Your side of it:

  1. Sign over the current title, and any listed lienholder signs a release as well.
  2. A Twin Falls car built after 2010 and weighing under 16,000 lb needs the seller's odometer disclosure.
  3. Selling it as a non-runner for scrap? Put "for junk only" on the title's front. From then on, no one may drive it on a highway.

A car cannot be dismantled on paper alone; each owner surrenders the title to ITD for cancellation. If the title is missing, a notarized ITD 3367 replaces it. See selling with no title.

If the insurer totaled it

A total loss in Idaho has no percentage cutoff. A Twin Falls car turns salvage in three ways. It is declared salvage, an insurer pays it as a total loss, or parts and labor less its salvage value make repair uneconomical. Idaho then issues a salvage certificate of title, and a repaired car gets a title branded "rebuilt salvage vehicle." See insurer totaled it.

Plates, the release, and no smog check

In Idaho the seller keeps the plates and registration card. Register your next vehicle and pay $5 to move the plate onto it. After handing over the car, a Twin Falls seller has 5 days to get the $3.50 release of liability to ITD. Then later tickets, towing or storage stop being your problem. You won't need an emissions test either. Idaho dropped that rule effective July 1, 2023. The Idaho page gathers the state rules, and after you sell the last steps.

Questions people ask

What do I owe to get an impounded car back in Twin Falls?
Under Section 6-5-4, the towing and storage costs are a lien in favor of the city, and anyone claiming the car pays all of them, storage included, before getting it back.
A stranger's car was dumped in my Twin Falls yard. Who removes it?
Section 9-12-8 lets a person in possession or control of real property have an abandoned vehicle on it removed by a peace officer. Under state law, someone in control of non-commercial, unposted property can also sign a release form and have a tow company haul it away.
Does Twin Falls limit dead cars kept on private lots?
The city code sections we read cover streets, abandoned vehicles and impounds. We did not find a private-lot storage rule among them; one could sit in a part of the code we did not read.
