Selling a junk or dead car in Pocatello

In Pocatello, even a car you are allowed to fix outdoors has to wear a fitted cover. When a permitted project car is not being worked on, the city code says it must be "under a car cover which has been specifically made to fit the contours of and cover the entire body of the vehicle; blankets, tarpaulins, or other such makeshift coverings are not allowed." Without a permit, a dead car is not allowed outside a building at all.

The rule for private property

Section 8.14.050 declares a nuisance the presence on private property, "outside the confines of enclosed buildings, of inoperative, wrecked, discarded, partially dismantled, junked vehicles or vehicle parts." The code gives its reasons: broken glass, standing water, rusted parts piling up and possible damage to the environment.

The ban does not apply to a lawfully run auto salvage, towing and storage, or auto sales business where the vehicle is needed for that business, or to a government auto storage area. It also does not apply to cars that hold a repair or restoration permit.

The two permits

Code enforcement staff issue both.

PermitLengthWhat it covers
Repair30 daysOne inoperative car repaired at home using parts from a second car you also own
RestorationOne yearOne car restored to original condition: a "classic" (at least 25 years old) or an "Idaho old timer" as the code defines it

Under the repair permit, both cars sit under fitted covers whenever they are outside and not actually being worked on. Thirty days is not long for a swap that stalls. If the parts car has given all it can, or the repair is not going to happen, selling the cars whole beats renewing the problem. See part it out or sell it whole and old project car.

When two cars make a salvage yard

Pocatello's zoning definitions set a low bar. "The storage of two (2) or more unlicensed or inoperative vehicles constitutes an auto salvage yard." That chapter also says outdoor storage means junked or inoperative vehicles kept outside a building "for seventy two (72) hours or more." So in Pocatello, a second dead car by the house is more than a mess. It changes how the lot is classed.

The street is for running, registered cars

Section 8.16.030 allows short- and long-term curbside parking only for "lawfully registered, operative motor vehicles." Using the streets to store unregistered or inoperative cars is prohibited, and "the owner(s) may be issued a misdemeanor citation." Anything stored that way is subject to removal, and the owner pays for it, storage included. A car with lapsed tags parked at the curb is in that group even if it starts.

Title and plates in Bannock County

Private-sale title paperwork goes through the Bannock County assessor's motor vehicle office. A title runs $14 with the county's admin fee added. Buyers who file after 30 days pay $20.00 extra.

  • Sign over the current title. Any lender listed signs a release as well.
  • Cars newer than 2010 that weigh less than 16,000 lb need the odometer disclosure done.
  • If the car is done driving for good, put "for junk only" on the face of the title. It stays on every later title.
  • If the car will be dismantled, the title must be surrendered to ITD. Failing to do that is unlawful, so a junk car still needs its title. If yours is lost, file the ITD 3367 with a notary stamp. More on that in selling with no title.

Keep the plates and registration card. A $5 transfer fee puts the plate on your next registered vehicle. Pocatello sellers then file the release of liability with ITD no later than 5 days after the handover. It costs $3.50 and keeps later tickets, towing or storage off your plate. The Idaho page has the full state rules; after you sell covers the rest.

Questions people ask

Is it okay to leave a broken car in my Pocatello driveway during repairs?
Only with a permit. Section 8.14.050 bars inoperative, wrecked or junked vehicles outside enclosed buildings. Code enforcement can issue a 30-day permit to repair one car using parts from a second car you own, and both must sit under fitted car covers when no one is working on them.
Will a tarp count as a cover in Pocatello?
No. The code requires a car cover made to fit the vehicle's contours and cover the whole body, and says blankets, tarpaulins and other makeshift coverings are not allowed.
Can I leave an unregistered car on a Pocatello street?
No. Section 8.16.030 bars using the streets to store unregistered or inoperative vehicles. The owner can get a misdemeanor citation, and the owner pays for removal and storage.
Are the plates mine to keep after a sale?
Yes. When a Pocatello car sells, the plates and registration card stay with the seller. Pay $5 and the plate can go on your next registered vehicle.
