Selling a junk or old car in Attleboro

Some old cars in Attleboro garages never had a title, and legally they never needed one. Massachusetts exempted passenger vehicles of model year 1980 and earlier, if bought before Nov. 26, 1990, from titling altogether. For those, the last registration plus a bill of sale is enough to sell. Old project or newer car that quit, we buy whole non-running and junk cars, and you sell the whole car as it sits.

Old cars without a title

With an exempt car, the buyer registers it using the last owner's registration and a bill of sale where a title would normally go. So before an old car leaves Attleboro, dig out the most recent registration you have and write a bill of sale that shows the price. Both conditions must hold: model year 1980 or earlier, and purchased before Nov. 26, 1990. A car of the right age bought after that date does not qualify.

A newer car with a lost title is a separate problem; begin with junk car with no title.

Attleboro's rules on stored cars

We could not find Attleboro's ordinances online, so this section covers only Massachusetts law. Attleboro may set its own rules for cars kept on a lot, and the city can confirm that before a dead car sits.

  • Towing off private land. Chapter 266, section 120D, forbids moving a car from private property unless the person in lawful control told the driver not to park there, in person or with a posted sign, and police are told. Doing it anyway risks a fine of up to $100. Massachusetts sends these questions to local police guides.
  • Left on a way. In Attleboro, 72 hours is the limit under Chapter 90, section 22C. After that, a street officer may remove a car that looks abandoned on any public or private way, or on land without the owner's okay, if towing and disposal would run higher than the car's value. It may then be scrapped as refuse.

Newer cars: the title itself

For a titled car, the RMV's private-sale steps are brief. First the seller fills in the mileage. Both the Attleboro buyer and seller then sign, print their names and date the transfer section of the title. Write the price on the title's price line if it has one, or else on a bill of sale. Notarization is not one of the steps.

Then comes the buyer's side. The application is filled out, stamped and signed by a licensed Massachusetts insurance agent. The RMV would rather buyers go through agents and dealers, and the title has to be done within 10 days of buying.

Plates and the excise bill

Plates stay with the Attleboro seller. Cancel online, hold on to the receipt, and pass your insurer a copy. Then an Attleboro seller can cut or recycle the plates, or put them on a new car inside 7 calendar days. There is no fallback: the RMV issues no temporary plates.

Cancelling also stops Attleboro's excise, which the city charges at $25 per $1,000 of value on any registered car.

Questions people ask

Can I sell my old car in Attleboro if it was never titled?
If it is a passenger vehicle of model year 1980 or earlier and was bought before Nov. 26, 1990, Massachusetts never required a title for it. It transfers on the previous owner's registration plus a bill of sale, which the buyer submits in the title's place.
When is a bill of sale required?
Whenever the title lacks a space for the sale price, a bill of sale showing it must go in with the buyer's paperwork. Exempt older cars use one as well.
Is there an Attleboro ordinance on junk cars?
We found none online, so the page covers Massachusetts law. Attleboro may still have rules on stored cars; ask the city before a dead one sits for months.
